PROJECT LOCATION: 227-15 N. Conduit Ave. Laurelton, NY 11413

PROJECT DESCRIPTION: Eon Labs, Inc. has filed an application for an initial Title V Permit. The facility currently has a valid Air State Facility Permit. The applicant operates a pharmaceutical formulation and preparation plant located in Laurelton, NY 11413. The facility's current volatile organic compound (VOC ) emissions are greater than 25 tons per year and as such is subject to Title V requirements. The facility is proposing to operate its VOC emitting sources under a Part 233 variance until the end of 2007 by which time the applicant will relocate the significant VOC emitting sources to North Carolina.

PERMITS: The applicant has applied for a Title V facility permit pursuant to 6 NYCRR Part 201.

SEQR STATUS: Pursuant to the State Environmental Quality Review Act ("SEQR"), ECL Article 8 and 6 NYCRR Part 617), the Department of Environmental Conservation (DEC) has determined that the project will not result in significant adverse environmental impact. The project is an Unlisted action under SEQR and DEC has issued a Negative Declaration.

NOTICE OF COMPLETE APPLICATION: The Department has prepared a Draft Permit and has made a tentative determination to approve this application. The Complete Application was noticed in the Environmental Notice Bulletin on September 7, 2005, and in the New York Post on September 8, 2005.

PUBLIC HEARING: A legislative hearing for the receipt of public comments on the application will be held, beginning at 6:00 PM, on Tuesday, February 21, 2006, at PS 156, 229-02 137th Ave., Laurelton, NY 11419. All persons, organizations, corporations, or government agencies who may be affected by the proposed project are invited to attend the hearing and to submit oral or written comments on the application. It is not necessary to file in advance to speak at the hearing. Lengthy comments should be submitted in writing. Equal weight will be given to both oral and written statements. The Administrative Law Judge ("ALJ") may limit the time available for oral comments to 5 minutes per person to ensure that all persons have an opportunity to be heard. The hearing facility is reasonably accessible to the mobility impaired.

WRITTEN COMMENTS: Parties may file written comments with the NYS DEC Division of Environmental Permits, Department of Environmental Conservation, Region 2, Hunter Point Plaza, 47-40 21st St., 2nd Fl., Long Island City, NY 11101, attn: Elizabeth Clarke. Written comments must be postmarked no later than Tuesday, February 21, 2006.

STATUTORY and REGULATORY PROVISIONS: The air permit application is being reviewed pursuant to ECL Article 19 (Air Pollution Control) and 6 NYCRR Part 201 (General Provisions - Air Pollution Control); Part 617 (SEQR); and Part 621 (Uniform Procedures).
