The applicant proposes to
modify an existing SPDES permit to add an outfall discharging
1000 gpd from an existing facility water softener to the Kahseway Kill, a class C
waterway. The draft permit has also been modified to update effluent limits, disinfection
requirements, and monthly reporting requirements. The department has made a tentative
determination to issue a modified permit for a SPDES permit under Article 17 of the
Environmental Conservation Law. This tentative determination indicates that the
discharge regulated under this statute is considered to satisfy regulatory standards for
permit issuance, based on information available to the Department at this time. As a
tentative determination, the Department seeks comments on the proposed regulated
activity prior to makeing a final decision on permit issuance. As such, this tentative
determination does not signify Department approval for, or endorsement of, the activity
for which a permit is sought, or for the overall proposed project. A draft permit is
available for inspection and comment at the Region 4 Office.

The applicant proposes to
construct and operate a Used Oil Transfer Facility at #207-274
Flatbush Road, West Coxsackie. The facility would consist of a 60 x 80 foot metal
building which would house two truck bays for loading and off-loading used oils and fuel
oils. The facility would also house up to six petroleum storage tanks ranging in size from
1,000 to 20, 000 gallons. Small loads of collected waste oils and fuels would be
consolidated into the tanks before being transported to recycling facilities.
