ENB Region 3 Completed Applications 01/18/2006

Applicant proposes to construct a driveway access from Foxwell Terrace across approximately 200 feet of Freshwater Wetland DP-26 (class 2) to a proposed residence to be constructed upland of the wetland and its 100 foot adjacent area.  The property to be developed is Lot 3 of the approved Robert Pearson & Terry Lee Williams Subdivision(Filed Map No. 6744).  A well is to be installed in the wetland adjacent area. The property is located on the east side of Foxwell Terrace, approximately 2,000 feet south of its intersection with Mills Road.

The applicant proposes to add blasting and extraction of shale at an existing 55-acre "life of mine" sand & gravel mine. Extraction would take place on two areas totaling approximately 18 acres. The location is on the west side of NYS Route 209 just outside of the City of Port Jervis municipal boundary.

The Department has made a tentative determination to approve this application for a new SPDES permit # NY-0271225 for Lake Arkin STP, servicing the new 27 lot subdivision residential known as Lake Arkin Estates, to discharge up to 10,300 gallons of treated wastewater per day to an unnamed tributary of Rutgers Creek (NYS Water Index # H-139-13-62-17;  Class C).    The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits.  

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz.

    The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to approve this application for a Title V Permit Renewal for the applicant’s facility.

    Georgia Pacific - Warwick Facility is a packaging printing facility.  Operations include flexographic printing of polyethylene materials.  Emissions of volatile organic compounds (VOC) from the facility are above major source thresholds, as defined by the federal Clean Air Act, and therefore a Title V permit is required.

    The facility consists of three printing presses, a parts washer and a plate making operation.  A regenerative thermal oxidizer is utilized to reduce VOC emissions and meet VOC control requirements.  The printing process is subject to Part 234 and the parts washing is subject to Part 226.  The facility is also subject to 40CFR 64 Compliance Assurance Monitoring (CAM) Rule.

    By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

    In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA)  has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or  6NYCRR Part 201.

    Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.  It is recommended that an appointment be made to confirm the availability of the subject files.  The DEC will endeavor to make the files available within two (2) business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.

    DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.  A public hearing may be legislative or adjudicatory.  A legislative public hearing is a proceeding which provides an additional opportunity for public comment.  DEC’s determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists.   If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments.   The applicant and all persons who  have filed comments on the permit will be notified by mail of the public hearing.  Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.

    An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination.  An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist.  A copy of the Department’s permit hearing procedures is available upon request or on the Department web site at: www.dec.state.ny.us/website/ohms/gudph1.htm.

The Department has initiated a modification of this State Pollutant Discharge Elimination System (SPDES) permit for the Town of Thompson Kaimesha Lake Sewer District Sewage Treatment Plant (STP.)  The Permit has been modified in accordance with 6NYCRR 750-1.18 and New York State’s  Environmental Benefit Permit Strategy (EBPS). Permit Limits, Levels and Monitoring -

Mass limits - Mass limits for UOD and TSS were rounded to 2 significant figures in compliance with DEC guidance in the DMR Manual for Completing the Discharge Monitoring Report for the SPDES, NYSDEC, February, 2002.

Added parameters - The TSS limit in the permit has been extended through the whole year.

A new ammonia limit has been added to the permit for the winter season.  This is a new water quality standard.

A new dissolved oxygen limit has been added to the permit.  This is a new water quality standard.

The Department has made a tentative determination to approve this application for re-issuance of SPDES permit # NY-0150363 for Samaritan Village, Inc, located at 751 Briggs Highway, Ellenville, to discharge up to 40,000 gallons of treated wastewater per day to Cape Pond (AKA Ulster Lake, NYS Water Index # H139-14-38-3-797a; Class B).  

The applicant proposes no changes to the existing sand filter treatment system.  The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits.
