Under the supervision of
the Chemung County Soil and Water Conservation District, the
applicant proposes to remove approximately 700 cubic yards of gravel deposition from
hurricane Ivan within a tributary to Post Creek. A portion of the work will be done
within Freshwater Wetland BD-2 (Class II) and its 100-foot adjacent area. There is an
existing railroad right of way that will be used for equipment access. All the excavated
material be trucked offsite to an upland location outside the wetland and its 100-foot
adjacent area. The project site is located approximately 1500 feet north of Campground
Road adjacent to the New York Central Railroad tracks in the Town of Catlin, Steuben
County.

The City of Canandaigua
proposes to install stone riprap and rock vanes in Sucker Brook
at four locations within the City of Canandaigua. Approximately 500 linear feet of
stream bank will be disturbed. The project will reduce stream bank erosion and sediment
transport to Canandaigua Lake while also providing protection to structures and
driveways adjacent to the channel. The work in Sucker Brook will be situated within
densely developed areas near Parrish Street, Bristol Street, Chapin Street and West
Avenue.

The Department has received
an application for re-issuance and modification of a
previously issued Freshwater Wetland Permit which allowed the construction of two
stormwater management facilities within the 100 foot wide adjacent area of NYS
Freshwater Wetland FA-6 (Class 3 ). The stormwater management facilities are
associated with the development of the Falcon’s Nest Subdivision, a 19-lot subdivision
located on westside of Victor Egypt Road, approximately 1200 feet south of intersection
of Spring Creek Drive, which is approximately at the Monroe - Ontario County
Boundary. Under the previous permit approval the permittee was to construct a spilt rail
fence at the upland boundary of the wetland adjacent area, where this boundary occurred
on Building Lots 13, 14, 15, 17, 18, and 19. The fence alignment also coincides with the
boundary of a Conservation Easement, where the Town of Victor and the developer had
agreed that the developmental restrictions provided by the conservation easement would
prevent any disturbance to the natural condition of the freshwater wetland and wetland
adjacent areas located on the building lot properties.
Subsequent to building of
the home on Lot 15 (aka 6742 Falcon’s Point), according to
approved plans, the permittee has requested a modification to the placement of the fence
and a revision of the conservation easement on this property. Citing minimal space for
development of a backyard on this property due to the position of the fence and the
conservation easement and the resulting hardship at marketing the home that has been
constructed, the permittee has requested that the fence location and conservation
easement boundary be changed to coincide with the edge of an existing treeline to the
rear of the house. The portion of the adjacent area which would be allowed to be lawn is a
portion of a previous crop field and the lawn development will not result in removal of
mature trees or disturbances to the wetland itself. The realignment of the fence location to
the edge of the treeline on Lot 15 will also require minor modification to the fence
alignment on Lot 14. The resulting modification would allow lawn areas to extend into
the adjacent area for an average distance of approximately 45 feet, which would represent
approximately 9100 square feet ( 0.22 acre ) of wetland adjacent area which would be
converted to lawn and be maintained by property owners. There are no additional changes
to the original fence alignment or additional disturbances to the wetland adjacent area on
other building lots within the subdivision.

The applicant proposes to
prevent additional bank erosion within Shequaga Creek at Mill
Hill Road in the Town of Dix, Schuyler County. They propose to install 125 feet of rip
rap on the south side of the stream, and approximately 35 feet of rip rap on the north side
of the stream extending from the northwest abutment. Approximately 193 cubic yards of
gravel bar material will be removed and used as back fill. The stream will be diverted
during construction and disturbed areas will be seeded and mulched at the completion of
the project.
