    The applicant proposes a modification to increase the flow limit from a 30 day arithmetic mean of 78,000 gallons per day (GPD) to 90,000 GPD of treated wastewater to Corbeau Creek (Class D) from a Sequencing Batch Reactor Activated Sludge System - Treatment Plant at the applicant's facility located at 641 Ridge Road, Chazy, NY.  The increase in flow will accommodate future expansion, addition of a 4th chiller and system design capacity increase from sand filter upgrade.   A draft permit has been prepared which has been modified to include: an increase to the flow rate, multiple revisions to monitoring requirements, the addition of a mercury pollutant minimization program and best management practices plan, and a schedule to reduce phosphorous discharge in accordance with the established Lake Champlain total daily monitoring limit (TDML).

    The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System under Article 17 of the Environmental Conservation law.  This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time.  As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.  As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.
