Applicant proposes to increase
the Daily Average flow rate from 95,000 gpd to 130,000
gpd from outfall 003. The proposed limits for BOD5, COD and TSS have also been
increased accordingly and in accordance with 4OCFR 439D. Limits for the other
parameters (concentration and mass based limits) remain unchanged.
The department
has made a tentative determination to issue a permit for a State
Pollutant Discharge Elimination System permit under Article 17 of the Environmental
Conservation law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such, this tentative determination does not signify
department approval for or endorsement of the activity for which a permit is sought or for
the overall proposed project.

The permittee proposes
the modification of their existing mining permit. The
proposed modifications include a proposal to increase the hours of operation to
allow operation 24 hours a day on Monday-Friday. Saturday and Sunday operation
would not change and would continue to be limited to daylight hours. In addition,
the permittee has also proposed to modify the mining plan to authorize a 15 acre
excavation to a depth below the water table (up to 35' deep) within the already
approved life of mine. This change in mining plan would be for the purpose of
facilitating the permittee’s silt removal process. Areas of the 15 acre area would be
backfilled with silts removed from the washing operation such that there would be
no change in the reclamation plan.
