Application for renewal of an existing Mined Land Reclamation Permit.  The Applicant proposes to continue the previously approved activity on the same site without material change.

But for the extensive public interest in the project, Regional NYSDEC Staff would be supporting issuance of the renewal.  By letter dated October 2, 2003, the Town of Brookhaven Department of Law requested that the NYSDEC modify the permit for this project pursuant to 6 NYCRR 621.14(a) (4), due to noise issues.  In addition, Department Staff periodically has learned of noise complaints regarding the site.  However, Department Staff has been unable to substantiate such complaints.  By letter dated February 5, 2004 NYSDEC Staff declined to modify the permit.

The Department has made a tentative determination to issue a permit modification for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation law.

The facility, Suffolk Community College Eastern campust requests a modification to revise the plant capacity from 35,000 gpd to 12,000 gpd as well as the plant operation mode to SBR.  The facility is located at Old Moriches-Riverhead Road, Riverhead, Town of Southampton.

This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulator standards for permit issuance based on information available to the Department at this time.  As a tentative determination, The Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.  As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.  Refer to this application by application number listed above and SPDES number NY 0078131.  A copy of the application and draft permit are available at the Region I Stony Brook Office.
