The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for remediation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

Please note the application package includes the Draft Remedial Work Plan which describes how the contamination related to the site will be addressed. The Final Remedial Work Plan implements the decision document for the remedy selection process for the site.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Positive Declaration

Niagara County - The Town of Wheatfield, as lead agency, has determined that the proposed Brookshire Subdivision may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Public Scoping Session to be scheduled. The action involves 75 single-family patio homes, 17 single-family homes, and 2.82 acres of commercial development within a Planned Unit Development, and associated roadways, drainage structures and public utilities (sanitary sewers, water, electric, natural gas, etc.) within a 82.9 acre parcel. The project site is currently zoned R-R (Rural Residential) and C-1 (Commercial). The project is located on the south side of Loveland Road in the Town of Wheatfield, Niagara County, New York.

Notice Of Acceptance Of Final EIS

Monroe County - The Board of Education of the Fairport Central School District, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Fairport Central School District 2005 Capital Improvements Project. The action involves internal and external renovations at all District facilities; additions to Brooks Hill Elementary School, Jefferson Avenue Elementary School, Johanna Perrin Middle School, Martha Brown Middle School, Minerva DeLand School, Fairport High School, and the District Offices; construction of a new elementary school, White Brook Elementary, on District-owned lands. The project is located in all District facilities within the Town of Perinton and Village of Fairport, Monroe County.
