ENB Region 1 Completed Applications 12/07/2005

The Department has prepared a Draft Permit and has made a tentative determination to approve this application for an Air State Facility permit pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law (ECL).  The facility operates three Babcock and Wilcox (10.5 mmBtu/hr each) and one Cleaver Brooks (25.193 mmBtu/hr) dual fired boilers, two ethylene oxide sterilizers and various exempt and/or trivial sources. The dual fuel fired boilers burn natural gas as primary fuel and distillate oil as a back up fuel. The facility's potential to emit (PTE) oxides of nitrogen (NOx) exceeds the major facility threshold of 25 tons per year (tpy).  The proposed State Facility Permit caps NOx emissions at the facility to less than 22.5 tpy by providing a method to demonstrate that fuel usage, on a monthly rolling basis, is limited such that the NOx regulatory threshold will not be exceeded.  The facility has agreed to accept permit conditions that will limit facility wide emissions of oxides of nitrogen at 22.5 tons per year.  By accepting these state and federally enforceable limits the facility will not be subject to the provisions of the Title V operating permit program.  The application and the draft permit are available for review at the Region 1 office in Stony Brook.  The facility is located at One Healthy Way, in the Hamlet of Oceanside, Town of Hempstead, Nassau County.

The applicant proposes to construct a single family dwelling, decking, pervious driveway, sanitary system, fencing, and drywells within the 100 ft. adjacent area of Freshwater Wetland I.D. SO-45.  The property is located on Midway Road, Southold, County of Suffolk, SCTM No. 1000-90-02-028.
