Project Description:
Elgen Associates, Inc., has applied for a Freshwater Wetlands permit to construct part of a 5,000 square foot building, 14 of 20 parking spaces and a stormwater basin within the 100-foot wide adjacent area of state regulated freshwater wetland #WF-3 (Class 2). Elgen Associates received a variance from the Town to move the proposed building 30 feet closer to the Old Route 9 then allowed under local zoning to avoid the wetland adjacent area as much as possible. Sanitary wastes would be piped to the Town's municipal sewer system. The total disturbance of the adjacent area would be 0.42 acres, but there would be no disturbance of the freshwater wetland itself. The 1.33-acre parcel is located on the east side of Old Route 9 between it and NYS Route 9 approximately 0.2 miles south of Middlebush Road (County Rt 93), in the Town of Wappinger, Dutchess County, NY.
State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency:
None Designated
State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than Dec 16 2005.
