Notice of Intent to Issue an Interim Order for County Line Field Which Establishes Spacing Units and Releases Royalties
The Department hereby gives notice of its intent to issue an Interim Order ("Order") to establish spacing units and release royalties for the wells in County Line Field listed in the following table. This notice is given pursuant to Environmental Conservation Law ("ECL") §23-0503(5). The Order to be issued pursuant to this notice will NOT include terms and procedures for integrating interests in the spacing units. Integration terms and procedures will be established by a final order at a later date.

Important milestones regarding the development of County Line Field and the hearing process with respect to the three units to be established by the Order are as follows:
- Fairman Drilling Company ("Fairman") began development of County Line Field in July 2000. In May 2002 Pennsylvania General Energy Corporation ("PGE") commenced drilling operations in the field. These companies subsequently conveyed their interests to Fortuna Energy Inc. ("Fortuna").
- The Department, Fairman and PGE entered a stipulation on December 30, 2002, which sets forth proposed spacing and integration rules for County Line Field. The stipulation is binding on Fortuna as successor to both Fairman and PGE.
- A Notice of Public Hearing and Negative Declaration was published in the February 26, 2003 issue of the Department’s Environmental Notice Bulletin and in the February 28, 2003 edition of the Elmira Star-Gazette.
- A public hearing took place in Painted Post, on March 25 and 26, 2003, on the matter of field-wide spacing and integration in County Line Field. The transcript of these proceedings can be viewed in the office of the Division of Mineral Resources, 625 Broadway, 3rd Floor, Albany, New York, 12233-6500. At the time of public hearing, the three wells listed above had been drilled and had commenced production. The Department required Fortuna to hold landowner royalties in an interest-bearing account until spacing units were established by a Department order.
- Assistant Commissioner Henry Hamilton’s Interim Decision dated May 24, 2005, and Decision dated August 24, 2005, directed Department staff to prepare an Order to establish unit boundaries in County Line Field.
The Mineral Resources regulations at 6 NYCRR 550.4 (f) state that, "Except as hereinafter provided, unless there is a significant indication of changed conditions, the department will not hold a hearing on any matter which has already been the subject of a prior hearing." Therefore, because configuration of the Purvis, Roy, and Whiteman spacing units as proposed by the Department and Fortuna has been previously reviewed and upheld through the hearing process, the Department is not seeking further public comment.

Negative Declaration
Monroe County - The Webster Central School District, as lead agency, has determined that the proposed Additions, alterations and renovations to District buildings/sites, will not have a significant adverse environmental impact. The action involves:
- Thomas High School - Alterations to site, classroom and support spaces to meet instructional program needs, provide for ADA accessibility, asbestos abatement, parking expansion (200) spaces and upgrading the natural turf field to artificial turf. Additions to include 12,000 sf classroom space and 16,000 sf physical education expansion to provide for change and increased instructional needs. Work to include improvements to mechanical and electrical systems.
- Spry Middle School - Alterations to site, classroom and support spaces to meet instructional program needs, provide ADA accessibility, parking expansion, and bus loop improvements. Additions to include 26,000 sf classroom and auditorium space and a 1,200 sf kitchen addition to provide for increasing enrollment and changing instructional needs. Work to include improvements to mechanical and electrical systems.
- Bus Garage - Expansion of parking areas.
- Buildings and Grounds - Provide addition to existing buildings and grounds structure storage building to house buildings and grounds department. Provide new entrance to access facility.
- Technology Department - Renovate building and grounds used by technology staff, including additional parking.
- Schroeder High School - Alterations to site, classrooms, and support spaces to meet instructional program needs, provide for ADA accessibility, asbestos abatement, athletic field, parking and bus loop improvements. Improvements to mechanical and electrical systems.
- Schlegel Road Elementary - Alterations to site, classrooms and support spaces to meet instructional program needs, provide for ADA accessibility, asbestos abatement, parking expansion, and bus loop improvements. Addition (7,000 sf) to provide classroom space for changing and increased instructional needs. Improvements to mechanical and electrical systems.
- Klem Road South Elementary - Alterations to site, classrooms and support spaces to meet instructional program needs, provide for ADA accessibility, asbestos abatement, parking expansion, and bus loop improvements. Addition (7,300 sf) to provide classroom space for changing and increased instructional needs. Improvements to mechanical and electrical systems.
- Klem Road North Elementary - Alterations to site, classrooms and support spaces to meet instructional program needs, provide for ADA accessibility, asbestos abatement, parking expansion, and bus loop improvements. Addition (5,900 sf) to provide classroom space for changing and increased instructional needs. Improvements to mechanical and electrical systems.
- Plank Road North Elementary - Alterations to site, classrooms and support spaces to meet instructional program needs, provide for ADA accessibility, asbestos abatement, parking expansion, and bus loop improvements. Addition (6,000 sf) to provide classroom space for changing and increased instructional needs. Improvements to mechanical and electrical systems.
- State Road Elementary - Alterations to site, classrooms and support spaces to meet instructional program needs, provide for ADA accessibility, asbestos abatement, parking expansion, and bus loop improvements. Addition (6,600 sf) to provide classroom space for changing and increased instructional needs. Improvements to mechanical and electrical systems.
- Dewitt Road Elementary - Alterations to site, classrooms and support spaces to meet instructional program needs, provide for ADA accessibility, asbestos abatement, parking expansion, and bus loop improvements. Addition (6,000 sf) to provide classroom space for changing and increased instructional needs. Improvements to mechanical and electrical systems.
- Plank Road South Elementary - Alterations to site, classrooms and support spaces to meet instructional program needs, provide for ADA accessibility, asbestos abatement, parking expansion, and bus loop improvements. Addition (7,000 sf) to provide classroom space for changing and increased instructional needs. Improvements to mechanical and electrical systems.
