The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Monroe County - The Town Board of the Town of Parma, as lead agency, has determined that the proposed adoptions of amendments to the Town Zoning will not have a significant adverse environmental impact. The action involves amendments to existing zoning regulations which include adding Twin Home Residences to the list of permitted uses in the Townhouse Residential District (TH) and to zoning schedule 1 for the Townhouse District. Modify regulations for the Townhouse District to clarify that development regulations apply to Twin Homes as well as to Townhouses and Multiple Residence developments. Indicate in the Townhouse District regulations and Zoning schedule 1 that no setback is required for Townhouse units and Twin Home residences where the lot line is located along a common wall. Remove "enclosed storage facilities operated as a commercial use" from the permitted principle uses in the General Commercial Zoning District and add multiple garage rental units" to the permitted principal uses. Clarify that the restriction on the number of dogs that may be kept or bred on a property is notwithstanding the provisions set forth in the New York State Agriculture and Markets Law, Section 109.2, titles Pure Bred License.

Steuben County - The Erwin Town Board, as lead agency, has determined that the proposed adoption of zoning amendments to Chapter 130 will not have a significant adverse environmental impact. The action involves the Erwin Town Board adoption of zoning amendments to Chapter 130 of the Code of the Town of Erwin which includes: the expansion of the Viewshed Protection Overlay District, amendments to the sign regulations; amendments to existing design standards for certain Zoning Districts; and other minor amendments to the Town of Erwin Zoning Ordinance.
