The NYS DEC Division of Environmental Permits has made a tentative decision to modify an existing Standard Activity Permit for certain activities regulated by Article 24 (Freshwater Wetlands) and Article 15 (Protection of Waters). The goal of this permit is to expedite the processing of wetland and stream protection permits for certain activities that are generally considered to have minimal impacts. The permit would include activities subject to jurisdiction under 6 NYCRR Part 608, involving stream or shoreline disturbances of 300 feet or less, which are also generally considered to have minimal impacts.
The activities authorized by this permit will include minor property improvements, replacements, reconstructions or expansions of existing structures or systems, minor utility installation projects, stream bank stabilization/channel restoration projects (300 feet or less), various vegetation management projects, and authorization for emergency repairs due to natural disasters.
Any interested parties and/or agencies desiring to submit comments regarding this permit may do so in writing no later than November 18, 2005. PROJECT TITLE: Weir Farm Sand and Gravel Mine
APPLICANT: John and Mary Weir, P.O. Box 177, Schaghticoke, NY 12154

PROJECT DESCRIPTION: - The applicant proposes to mine sand and gravel from a 32.7 acre life of mine area on a 156 acre parcel of land in the Town of Schaghticoke. The proposed project site is located on the south side of NYS Route 67, approximately one mile west of the intersection of NYS Route 67 and NYS Route 40.
PERMITS: - The applicant has applied for a New York State Mined Land Reclamation permit under regulations 6 NYCRR Part 420; NYSDEC application number # 4-3842-00089/00001; MLF # 40762.
PUBLIC HEARING AND WRITTEN COMMENT PERIOD: - All persons, organizations, corporations or government agencies which may be affected by the proposed project are invited to comment on the application. A Legislative Public Comment Hearing on the application will be held to receive unsworn statements from the public on December 6, 2005 at 7:00p.m. at the Schaghticoke Town Hall.
It is not necessary to file a written request in advance to speak at the legislative hearing. Written statements and comments on the application are encouraged and any statements and comments may be filed prior to or at the hearing, but no later than the deadline for written comments, which is December 2, 2005.

This hearing location is reasonably accessible to persons with a mobility impairment. Interpreter services may also be made available to deaf persons, at no charge, upon written request to the Regional Permit Administrator named below, no less than one week prior to the hearing, pursuant to SAPA § 202(1).
All persons having an interest in this project are urged to attend or be represented either individually or collectively.
Following the hearing, the Department will make a determination on whether substantive or significant issues have been raised as defined in 6NYCRR Part 621 Uniform Procedures and an Adjudicatory Hearing Issues Conference should be scheduled before an Administrative Law Judge. In order to raise substantive and significant issues written comments expressing objections to or opposition to the application must explain the basis of that opposition and identify the specific grounds which could lead the Department to deny or impose significant permit conditions on the project.
NOTE: The Department reserves the right to cancel the Legislative Public Hearing scheduled for December 8, 2005, if no written comments are received by COB on December 2, 2005.
