Prime
Equities, LLC has applied for a Water Supply permit (WSA #10,843) and a
Freshwater Wetlands permit in order to construct the proposed 51-unit "Preserve
Townhouses" development. The central water supply system would consist of two on-site wells; Well #1, is approximately 450 ft. deep and was pumptested at 64 gallons per
minute (gpm), and Well #2 approximately 505 ft. deep and was pumptested at 60 gpm.
The applicant also proposes to install a sewer line and a stormwater detention basin
within the 100 ft. wide adjacent area around state regulated Freshwater Wetlands # WF-27 (Class 3). The Town of Wappinger will extend municipal sewer service to this
proposed project
The
proposed townhouse project is located on 9.6 acres of a 47.9-acre parcel, the
balance of which is state regulated wetland along Hunter's Creek. The applicant proposes
to preserve as open space the undisturbed portion of the wetland for recreation trails that
may be used by the residents and the general public.
The
proposed project is located on the north side of Old Hopewell Road, about one-half mile east of the
intersection with NYS Route 9D. in the Hughsonville section of the
Town of Wappingers, Dutchess County, New York.

The
Department has made a tentative decision to approve emission reduction credits
(ERC's) for the past emission reductions of Oxides of Nitrogen (NOx) and Volatile
Organic Compounds (VOC's) which were the result of the shutdown of the tesa tape
facility in Middletown. The applicants application also requested ERC's for Carbon
Monoxide (CO) and Particulate Matter (PM-10) ERC's. Orange county is in attainment
of National Ambient Air Quality Standards for CO and PM-10 and as such New York
State does not certify ERC's for these contaminants in this area.
In
summary, as a result of the shutdown of the tesa tape facility (specifically emission
units U-50LIN, U-MIXER, U-CCALEN and U-49LIN) the Department intends to certify
5.9 tons of NOx and 143.8 tons of VOC ERC's as requested by the applicant. The
application and supporting documentation are available for review at the NYSDEC

The applicant proposes to
reconstruct portions of the Garrison Golf Club golf course and
construct facilities to provide 40 guest rooms, additional parking areas, additional
drainage/erosion control, and an expanded sub-surface sewage disposal system (SSTS).
The project site is located generally on the south side of Phillipse Brook Road and west of
New York-Albany Post Road (US Route 9). The Department has made a tentative
determination to approve this application for a SPDES permit under Article 17 of the
Environmental Conservation Law for the subsurface discharge up to 13,850 gallons of
wastewater per day from a total of three outfalls. A draft SPDES permit (SPDES No. NY-0248100) has been
prepared and is available for review at the NYSDEC Region 3 Office.
The facility is currently permitted for a subsurface discharge of up to 10,710 gallons of
wastewater per day.
Construction of the new
facilites will include the installation of a stormwater detention
basin and outfall on the bank of Phillipse Brook (DEC Water Index No. H-75; Class
B(TS)), a State-protected stream. A stormwater pollution prevention plan has been
prepared, as required by the SPDES General Permit for Stormwater Discharges from
Construction Activities (GP-02-01).
