The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

Please note the application package includes the Remedial Draft Investigation Work Plan which describes the remedial activities to be conducted to investigate and determine the nature and extent of the contamination related to the site.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Dutchess County - The Arlington Central School District Board of Education, as lead agency, has determined that the proposed Arlington Central School District 2005 Bond Project will not have a significant adverse environmental impact. The action involves the Arlington Central School District proposing to complete additions and renovations at its Senior High School. These actions consist of the following:

Arlington High School (SED# 13-16-01-06-0-008) – Additions to the existing High School consist of approximately 56,000 square feet of footprint (92,500 square feet of gross floor area). The additions proposed consists of two-story classroom additions, cafeteria additions and gymnasium additions, all attached to the existing structure. Other internal renovations are proposed for the High School.

In addition, other District schools will also have renovations involving roof replacements, tank replacements, sidewalk replacements, code upgrades, HVAC upgrades and other minor renovations. These projects are considered Type II Actions and as such, require no additional review under SEQRA.

The scope of this project has been reduced and orientation of the High School additions are different from the original proposed project. The additions have been moved to the front of the school to avoid impacts to the sanitary leach fields. Additionally, no pool is proposed. All work at these locations has been removed from the project and was not considered in this assessment of potential adverse environmental impacts. Arlington Senior High is located at 1157 State Route 55, in the Town of LaGrange, Dutchess County, NY.

Ulster County - The Town of Lloyd Town Board, as lead agency, has determined that the proposed Comprehensive Plan will not have a significant adverse environmental impact. The action involves final adoption of the Comprehensive Plan adopted with Neg Dec on GEIS September 14, 2005. The project is located in the Town of Lloyd.

Positive Declaration

Orange County - The Town of Blooming Grove Planning Board, as lead agency, has determined that the proposed Northwood Enterprises, LLC Site Plan (Tuthill Park) may have a significant adverse environmental impact and a Draft Environmental Impact Statement must be prepared. The action involves a senior citizen housing complex of 180 units on approximately 62 acres. The project is located on Tuthill Road and Route 94 in the Town of Blooming Grove.

Notice Of Acceptance Of Draft EIS And Public Hearing

Rockland County - The Town of Haverstraw Town Board, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Encore Haverstraw. A public hearing on the Draft EIS will be held on October 24, 2005, at 8:30 p.m. at Town Hall, 1 Rosman Road, Garnerville, New York. Public comments on the Draft EIS will be accepted until 10 days after the close of the public hearing. The action involves 1) the creation of a Planned Development District (PDD) and mapping this new zone on the 163 acre portion of the Letchworth Village Developmental Disabilities Center site located in the Town of Haverstraw, Rockland County, New York; (2) the creation and adoption of the Letchworth Village Urban Renewal Plan, which also include the former Power Plant Site; (3) the approval of the site plan and subdivision of the site; (4) the development of Encore Haverstraw, an active adult (age 55 and over) for sale, luxury residential and mixed-use community to contain: 500 residences (condominiums, townhouses, and single-family detached homes and 15 non-age restricted live-work loft style apartments); an inn with a spa and gourmet restaurant; a clubhouse; an outdoor pool (and potentially an indoor pool); a Village Green and Village Commons; approximately 50 acres of passive and active recreation space for use by the Town of Haverstraw, including a community center; approximately 30,000 s.f. of commercial, office and/or neighborhood retail facilities on the project site and the realignment of Letchworth Village Road.

Notice Of Acceptance Of Final EIS

Dutchess County - The Town of LaGrange Town Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Wastewater Master Plan Titusville Sewer District. The action involves adoption of the Wastewater Master Plan: Titusville Sewer District, Town of LaGrange, Dutchess County, New York, Plan dated April 13, 2005. Final Environmental Impact Statement dated September 23, 2005. A portion of the Town of LaGrange - with a general project location southeast of the Town of Poughkeepsie, just east of Wappingers Creek (which forms the Town boundary), west of the Taconic Parkway, north of Noxon Road and Cortland Drive, and generally south of the Sleight Pass and Overlook Roads intersections.

Orange County - The Town Board of the Town of Woodbury, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Zoning Amendments. The action involves two general zoning amendments which would create a Conservation Cluster Development overlay district and allow Senior Housing “for sale” units. The action also includes 3 site specific zoning amendments relating to the “WP3 Project,” a residential development of a 400 acre site, with access on Nininger Road (1500 feet west of the intersection with Dunderberg Road), containing a total of 451 units, 130 of which will be Senior Housing. These laws would change the zoning district from R-2A to R-1A; designate the total site for a Conservation cluster Development; and designate 45 acres of the site for Senior housing. Copies of the DEIS and FEIS are also at the Town libraries and Town Clerk’s office.

Notice Of Acceptance Of Final EIS And Public Hearing

Westchester County - The White Plains Planning Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Springdale Avenue Development, Development of 5 Lots on Environmentally Sensitive Site White Plains, New York. A public hearing on the FEIS will be held October 18, 2005 at 7:00 p.m. in the Common Council Chambers, Municipal Building, 255 Main Street, White Plains. The action involves new construction of five single-family dwellings on a site that is designated as an environmentally sensitive site with steep slope areas. The property is located in a R1-5 One-family Residential District which requires a minimum lot area of 5,000 square feet. The site is located approximately 1 mile easterly of the Downtown on Springdale Avenue between the intersections with Woodcrest Avenue and Sunset Drive. The site is accessed from Lake Street to Woodcrest Avenue to Springdale Avenue.
