The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for modification of an existing permit and the establishment of
Emission Reduction Credits (ERCs). The facility replaced the landfill gas consuming
engines after a fire at the facility on November 17, 1995 destroyed them. The
modification of these emission points enabled the permittee to lower certain emissions
and the applicant now requests establishment of certified emission reduction credits for
these past reductions which were the result of the more efficient diesel engines. The
owner requests the establishment of emission reduction credits of 79.15 tons per year of
Oxides of Nitrogen (NOx) in accordance with 6 NYCRR part 231, "New Source Review
in Nonattainment Areas."
In accordance with 6NYCRR
Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the authority to bar
issuance of any Title V Facility Permit if it is determined not to be in compliance with
applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting materials, the draft permit, and all other materials available to the
DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative listed below. It is recommended that an appointment be
made to confirm the availability of the subject files. The DEC will endeavor to make the
files available within 2 business days of contact, during normal business hours (8:30 am
through 4:45 pm), unless the requestor wishes to inspect the files at a later date.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative public hearing is a proceeding which provides an additional opportunity for
public comment. DEC's determination to hold a legislative public hearing will be based
on whether a significant degree of public interest exists. If a legislative public hearing
is
to be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and

An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to

Department has prepared a Draft Permit and has made a tentative determination to
approve this application for a renewal of Air State Facility permit. J Kings Food Service
Professionals Gen facility operates two Diesel enginegenerator sets for producing
electricity. Only one engine is operating at any one time. The facility is capped on
nitrogen oxide (NOx) emissions at 22.5 tons per year. This requires that the
enginegenerator sets operate at minimum gas/oil heat input ratio of 0.43 and do not
produce more than 3,300,000 kWhr of electricity per year. The facility owner/operator is
required to conduct engine emission testing once every five years during the term of the
permit, submit annual compliance certification reports, and keep the necessary records at
the facility to demonstrate compliance with the permit. A copy of the draft permit is
available at the Region 1 Stony Brook office.

The Department has drafted
a renewal to the initial Title V permit, pursuant to Article 19
(Air Pollution Control) of the NYS Environmental Conservation Law (ECL), and made a
tentative determination to approve the application which renews the applicant's existing
municipal waste combustor Title V facility permit. The facility consists of two mass burn
rotary type municipal waste combustor units, located at 4001 Veterans Highway,
Ronkonkoma, Town of Islip, Suffolkk County.
The facility was originally
permitted under the federal regulations 40 CFR 52-A.21, the
Prevention of Significant Deterioration (PSD) of air quality, Best Available Control
Technology (BACT) reviews. The facility is also permitted under the New York State
regulations 6NYCRR Part 219 (Incinerators), Part 225-1 (Fuel Sulfur) and federal
regulations 40 CFR 60, Subpart Db. The renewal contains the applicable requirements of
the new federal Emission Guidelines 40 CFR 60, Subpart BBBB which will become
effective on December 6, 2005. The facility has been retrofitted to comply with the
Subpart BBBB requirements which include but are not limited to two acid gas scrubbers,
carbon injection, secondary air handling system and other associated electrical and data
acquisision software updates.
