The applicant proposes to construct one water supply well, 20" x 10" in diameter, rated at 1,300 GPM installed to a depth of approximately 800 feet deep.  The stated purpose of the well is to relieve low pressure in some areas of the distribution system that occurs during peak hours.  The new well will help ensure that there is adequate water for both demand and fire protection.  The proposed well is located on the east side of  East Forks Road, between Massachusetts and Connecticut Avenues, North Bay Shore in the existing SCWA East Forks well field.

The Department has prepared a Draft Permit and has made a tentative determination to approve this application for modification of an existing permit and the establishment of Emission Reduction Credits (ERCs).  The facility replaced the landfill gas consuming engines after a fire at the facility on November 17, 1995 destroyed them.  The modification of these emission points enabled the permittee to lower certain emissions and the applicant now requests establishment of certified emission reduction credits for these past  reductions which were the result of the more efficient diesel engines.    The owner requests the establishment of emission reduction credits of 79.15 tons per year of Oxides of Nitrogen (NOx) in accordance with 6 NYCRR part 231, "New Source Review in Nonattainment Areas."

In accordance with 6NYCRR Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.  It is recommended that an appointment be made to confirm the availability of the subject files.  The DEC will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 am through 4:45 pm), unless the requestor wishes to inspect the files at a later date.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing.  A public hearing may be legislative or adjudicatory.  A legislative public hearing is a proceeding which provides an additional opportunity for public comment.  DEC's determination to hold a legislative public hearing will be based on whether a significant degree of public interest exists.   If a legislative public hearing is to be held, a Notice of Hearing will be published which will include the time and place of the hearing and submitting comments.   The applicant and all persons who  have filed comments on the permit will be notified by mail of the public hearing.  Comments and requests for a legislative public hearing should be in writing and addressed to the Department representative listed below.

An adjudicatory public hearing is a trial type proceeding which provides the opportunity for adjudication on the basis of evidence, including direct testimony and cross examination.  An adjudicatory hearing is held only if substantive and significant issues relating to any findings or determinations the Department is required to make pursuant to the Environmental Conservation Law exist.   A copy of the Department's permit hearing procedures is available upon request or on the Department web site at: www.dec.state.ny.us/website/ohms/gudph1.htm.

The applicant proposes to expand an existing well from 250 gpm to 500 gpm, for the purpose of irrigation. The proposed well has a diameter of 12" and is approximately 50' deep.  The site is located south of Otis Rd. and east of Wood Acre Rd., Bellport, Town of Brookhaven.

The applicant proposes to raise the existing parking lot and install retaining walls and drainage structures designed to eliminate the existing direct discharge from the Town of Brookhaven Lake Ronkonkoma Park parking lot directly into Lake Ronkonkoma. The applicant also proposes installation of a handicapped accessible 8'4" x 140' floating dock. The facility is located at Pond Road/Lake Shore Road w/o Lake Terrace, SCTM#200-724-1-29 and 500-22-2-51.2 & 52, Ronkonkoma, Brookhaven Town, Suffolk County on Lake Ronkonkoma class I state FWW#P-1.      

    The Department has prepared a Draft Permit and has made a tentative determination to approve this application for a renewal of Air State Facility permit. J Kings Food Service Professionals Gen facility operates two Diesel enginegenerator sets for producing electricity. Only one engine is operating at any one time. The facility is capped on nitrogen oxide (NOx) emissions at 22.5 tons per year. This requires that the enginegenerator sets operate at minimum gas/oil heat input ratio of 0.43 and do not produce more than 3,300,000 kWhr of electricity per year. The facility owner/operator is required to conduct engine emission testing once every five years during the term of the permit, submit annual compliance certification reports, and keep the necessary records at the facility to demonstrate compliance with the permit.  A copy of the draft permit is available at the Region 1 Stony Brook office.

The Department has drafted a renewal to the initial Title V permit, pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL), and made a tentative determination to approve the application which renews the applicant's existing municipal waste combustor Title V facility permit.  The facility consists of two mass burn rotary type municipal waste combustor units, located at 4001 Veterans Highway, Ronkonkoma, Town of Islip, Suffolkk County.

The facility was originally permitted under the federal regulations 40 CFR 52-A.21, the Prevention of Significant Deterioration (PSD) of air quality, Best Available Control Technology (BACT) reviews.  The facility is also permitted under the New York State regulations 6NYCRR Part 219 (Incinerators), Part 225-1 (Fuel Sulfur) and federal regulations 40 CFR 60, Subpart Db.  The renewal contains the applicable requirements of the new federal Emission Guidelines 40 CFR 60, Subpart BBBB which will become effective on December 6, 2005.  The facility has been retrofitted to comply with the Subpart BBBB requirements which include but are not limited to two acid gas scrubbers, carbon injection, secondary air handling system and other associated electrical and data acquisision software updates.

The applicant proposes to construct additions totaling 74.5 square feet to an existing single family dwelling; construct a 138 square foot second story deck; and install a new roof.  NYSDEC regulated tidal wetlands associated with Pond Point Pond are located on the parcel.  The additions are proposed within 10 feet of the tidal wetland boundary.  A variance from the required 75 foot tidal wetland setback has been requested for the additions.  The project is located at 450 Dune Road, Westhampton Beach, Town of Southampton, Suffolk County.  SCTM # 905-17-1-2.3.
