The applicant proposes to
reconstruct an existing roadway crossing within State-designated Freshwater Wetland HP-21 (Class I)
and construct a new sanitary wastewater
treatment plant with a treatment capacity of 66,100 gallons per day (GPD). The project
site is located on the west side of NYS Route 9G, approximately 0.6 mile north of the
intersection with Mill Road. The project would involve the disturbance of approximately
0.06 acre of wetlands for replacement of an existing 4-culvert crossing with a new single-span bridge
approximately 40 feet long. There will also be a total of about 0.06 acre of
impact to federally regulated wetlands for construction of utilities and an emergency
access road.
The Department has made
a tentative determination to approve this application for a
SPDES permit to discharge an average volume of 66,100 GPD from the proposed
wastewater treatment plant to Crum Elbow Creek [DEC Water Index No. H-124; Class
A(T)]. The permittee will be required to maintain records and report data to verfiy
compliance with the SPDES permit conditions and discharge limits. A draft SPDES
permit (SPDES No. NY-0078549) is available for review at the NYSDEC Region 3
office. A stormwater pollution prevention plan has also been prepared for the site
pursuant to the SPDES General Permit for Stormwater Discharges from Construction
Activities (GP-02-01).

The
Department of Environmental Conservation (DEC) has received an application to
re-issue/re-new the following pre-existing EPA minor Private/Commercial/Institutional
State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a
tentative determination to re-issue/re-new this pre-existing permit for a five year term
maintaining current effluent limitations and monitoring and reporting requirements. If
issued, the permit will also be modified to incorporate relevant changes to applicable
SPDES regulations (6 NYCRR 750) that have occurred since the previous renewal. This
permit involves the surface discharge through a septic tank and sand filter of up to 1,000
gallons per day of treated sanitary waste to Ananwana Brook.
Additional
information on this permit may be requested from or inspected at the
NYSDEC Central Office in Albany. Substantive comments must be submitted in writing
to the contact person. To be called substantive, 6 NYCRR Part 621.7 requires public
comments "explain the basis of opposition and explain specific grounds..." for
opposition.

Subdivision. The property is located on Deepwell Farms Road, north of Shady Lane,
across from the Meadow Pond Elementary School. All work associated with the
development of these combined lots will be done within the 100 foot adjacent area of
Freshwater Wetland D-36 ( Class II ). The access driveway will cross a portion of the
wetland itself. A vegetation restoration of an area of previously filled wetland is
proposed. In addition, a sediment basin is proposed to reduce impacts associated with a
road drainage pipe that discharges into an unnamed tributary ( Ct-10-P1111-2 ) of Scotts
Reservoir. Stone rip-rap will be placed at selected locations along this stream on the
property in order to reduce further erosion.

This new State Pollutant
Discharge Elimination System (SPDES) permit was drafted for
the Kensico Small Hydro Power Facility operated by the New York Power Authority
(NYPA). The facility has been in operation since 1983. The subject application was
submitted to NYSDEC on 03 January 2003 following an enforcement action at another
similar small hydro facility operated by NYPA. The permit authorizes the surface
discharge of non-contact cooling water from this small elecrtical generation facility to the
Kensico Aquaduct/Reservoir. The permit includes monitoring requirements for total
flow, oil and grease and temperature.

for review at the NYSDEC central office in Albany. SPDES
