The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for a renewal of Title V permit. The Carbo-Concord Oil facility
distributes gasoline and distillates. The facility includes six (6) gasoline storage tanks,
one (1) ethanol storage tank, and gasoline and distillate loading racks. The facility is
capped on volatile organic compounds emissions: 4.8 tons/year for emissions from tanks
and 39.1 tons/year on emissions from loading racks (6NYCRR Part 231-2 and 6NYCRR
Part 201-7). The facility’s gasoline throughput during any consecutive 12-month period is
limited to 382 million gallons. This permit renewal does not include any increase in
emissions from the previous Title V permit.
In accordance with 6NYCRR
Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the authority to bar
issuance of any Title V Facility Permit if it is determined not to be in compliance with
applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting materials, the draft permit, and all other materials available to the
DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative listed below. It is recommended that an appointment be
made to confirm the availability of the subject files. The DEC will endeavor to make the
files available within 2 business days of contact, during normal business hours (8:30 am
through 4:45 pm), unless the requestor wishes to inspect the files at a later date.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative public hearing is a proceeding which provides an additional opportunity for
public comment. DEC's determination to hold a legislative public hearing will be based
on whether a significant degree of public interest exists. If a legislative public hearing
is
to be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and
requests for a legislative public hearing should be in writing and addressed to the
Department representative listed below.
An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to
the Environmental Conservation Law exist. A copy of the Department's permit hearing

The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application requesting modification of existing Air State Facility Permit,
issued to NYS Pilgrim Psychiatric Center, (PSC). PSC has constructed a new boiler plant
that incorporates five new dual-fuel fired boilers (natural gas and distillate oil). The new
boilers are four Cleaver-Brooks Model CB(LE) 200-700-150 boilers with a heat input
below 30 mmBtu/hr each and one Cleaver-Brooks Model CB(LE) 200-400-150 boiler
rated at 16.7 mmBtu/hr. The facility shall enroll four diesel engines into an EDRP
program. The engines are as follows: One Alt-Detroit 744RSL7054 1625 kilowatts, two
Caterpillar Model 3516 1500 kilowatts, and one Caterpillar-Kato Model 3516 1750
kilowatts. The entire facility shall cap below 25 tons per year of NOx emissions. By
accepting this cap the facility shall not be subject to the requirements of 6 NYCRR
Subpart 201-6 Title V, 227-2 NOx RACT, and 231-2 New Source Review in Non-Attainment Areas.

The applicant proposes to
install approximately 50 feet of sheathing along the bottom half
of an existing bulkhead; construct approximately 28 feet of new bulkhead; install a 4 foot
by 5 foot platform, a 32 inch by 20 foot ramp, a 6 foot by 20 foot float and 5 support
pilings; replace an existing culvert; and dredge a 40 foot by 40 foot area of Sterling Creek
adjacent to the bulkhead. Approximately 68 cubic yards of dredged material will be
disposed of at St. Agnes Cemetery in Greenport, New York. Sterling Creek is considered
a NYSDEC regulated tidal wetland and the proposed dredging is considered an
incompatible use for a tidal wetland area. The project is located at 980 Manhasset
