The Department has drafted
an Air State Facility Permit pursuant to Article 19 (Air
Pollution Control) of the NYS Environmental Conservation Law (ECL) and Federal
Clean Air Act Amendments and made a tentative determination to approve this
application for a 750 kilowatt (kW) emergency combustion turbine generator at the
Jamestown Board of Public Utilities' (BPUs') Samuel A. Carlson Generating Station
(Carlson Plant) located at 136 Steele Street. The turbine will be used to provide
emergency starting capability for an existing LM6000 combustion turbine which operates
solely on natural gas. The emergency turbine will fire only distillate oil and has a
maximum heat input rate of approximately 13.4 million Btu per hour (MM Btu/hr). It is
subject to the Oxides of Nitrogen (NOx) Reasonably Available Control Technology
(RACT) regulations contained in 6 NYCRR Part 227-2. It is also subject to the sulfur in
fuel requirements of the New Source Performance Standards (NSPS) for Stationary Gas
Turbines in 40 CRF Part 60 Subpart GG because the maximum heat input is greater than
10 MM Btu/hr. However, it is not subject to the NOx emission limits of the NSPS for
Stationary Gas Turbines in 40 CRF Part 60 Subpart GG since the BPU has choosen to
limit the operation of the emergency turbine to less than 500 hours per year to meet the
definition of an emergency generator. The application, draft permit, relevant supporting
materials, and regulations are available for review during normal business hours at the
Region 9 Office of the NYS Department of Environmental Conservation in Buffalo.

This project proposal consists
of the installation of a new 64 MMBTU/hour maximum
heat input capacity boiler in the Power House at the Roswell Park Cancer Institute
(RPCI). This boiler will be used primarily to generate steam for the operation of a steam
turbine, which will produce electricity for use onsite. Emissions from this dual fueled
(natural gas or No. 2 fuel oil) boiler will be controlled via low NOx burners and flue gas
recirculation. The installation of the new boiler will increase the total maximum heat
input capacity of the Power House boilers from 249 MMBTU/hr to 313 MMBTU/hr,
making it one of the source categories with a major source threshold of 100 tons per year
(tpy) for regulated pollutants listed in Prevention of Significant Deterioration of air
quality under 40CFR52.21 (PSD). It has been determined that with the addition of the
new boiler, RPCI’s potential to emit carbon monoxide (CO) will exceed the applicability
threshold of 100 tpy CO for PSD and 6NYCRR Subpart 201-6, Title V Facility Permit
(Title V). To avoid the requirements of those regulations, RPCI has chosen to limit
facility-wide emissions of CO to 99 tpy or less. RPCI is currently implementing an
emissions cap to limit potential emissions of NOx and SO2 to less than 100 tons per year
to avoid the requirements of Title V, PSD, New Source Review (6 NYCRR Subpart 231-2) and NOx RACT (NYCRR227-2). The Department has prepared a draft Air State
Facility Permit with monitoring conditions to limit the emissions of CO from RPCI to
below 100 tons per year. By accepting these State and Federally enforceable permit
conditions, the RPCI will not be subject to Title V or PSD requirements for CO
emissions.

Applicant proposes construction
of an 89 lot single home subdivision at 7303 Bear Ridge
Road in the Town of Pendleton. The subdivision borders NYS Freshwater Wetland TE-10 along Trib 4 of
Tonawanda Creek. Stormwater retention ponds will be built partially
within the regulated 100 foot Adjacent Area of the Wetland. Sewer and water lines will
cross the Wetland. A 50 foot buffer will be seeded to conservation mix and left unmown.
A Protective Covenant will be filed for 13 lots along the wetland to assure long-term
protection of the Wetland.
