The Department
has initiated a modification of this State Pollutant Discharge Elimination System
(SPDES) permit for the City of Newburgh Sewage Treatment Plant (STP.) The permit has been
modified in accordance with 6NYCRR 750-1.18, New York State’s Environmental Benefit
Permit Strategy (EBPS).

pages are used, based on current Department guidance, format and nomenclature.
Permit pages are
renumbered and reordered.
The address for
the Bureau of Watershed Compliance on the Recording, Reporting and
Monitoring page have been updated.
A continuation
of the Discharge Notification Act requirements was added.
The pretreatment
program language has been updated to require continuation of the program and
annual reporting.
The CSO BMP (Best
Management Practices) language has been updated to include all 15 BMP’s
along with the LTCP (Long Term Control Plan) requirements in accordance with EPA’s national
CSO control policy and the wet weather water quality act of 2000.
The toxicity testing
requirements and footnote is now included in the permit limits, levels and
monitoring page.

Levels and Monitoring -
Mass limits
- Mass limits for BOD5 and TSS were rounded to 2 significant figures in compliance
with DEC guidance in the DMR Manual for Completing the Discharge Monitoring Report for the
SPDES, NYSDEC, February, 2002.
Removed parameters-
The action levels for methylene chloride, tetrachloroethylene, and
chloroform have been removed from the permit as these parameters have not been detected in the
effluent over the past three years.
The previous permit
required a high intensity sampling schedule for methylbenzene sulforanide.
Those results were non-detectable in plant effluent and methylbenzene sulforanide has been
removed from this permit.
Added parameters
- New acute and chronic toxicity testing requirements have been added to
the permit.
Monitored parameters
- Zinc, chromium and silver have been changed from action levels to
monitoring 1 /quarter because of very low effluent levels.
Bis (2-ethylhexyl)
Phthalate monitoring - A hi-intensity Bis (2-ethylhexyl) Phthalate
monitoring schedule has been added to the permit. Sampling will be required once per week for
a period of 3 months to gather data to determine whether Bis (2-ethylhexyl) Phthalate is
consistently present in effluent and needs to be limited.

This new State Pollutant
Discharge Elimination System (SPDES) permit was drafted for
the Kensico Small Hydro Power Facility operated by the New York Power Authority.
The facility has been in operation since 1983, however additional review of the facility by
DEC has revealed the need for a SPDES permit at this site. The subject application was
required per an Order on Consent, case number 3-20020321-43 and was duly submitted
to the NYSDEC on 03 January 2005. The permit authorizes the surface discharge of non-contact cooling
water from this small elecrtical generation facility to the Kensico
Aquaduct/Reservoir. The permit includes monitoring requirements for total flow,
oil/grease and temperature.
A draft permit is available
for review at the NYSDEC central office in Albany. SPDES
Number NY 026 8178.
