The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27–1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Chemung County – The Chemung County Legislature, as lead agency, has determined that the proposed lease of Chemung County Solid Waste Facilities to New England Waste Services will not have a significant adverse environmental impact. The action involves the lease of the Chemung County Landfill Complex; the Lake Street Materials Recycling Facility, milling and transfer station complex; the Big Flats transfer station; the Erin transfer station; the Southport transfer station and a portion of the Milton Street WWTF to NEWSNY for a period of 25 years.

The proposed action also includes the potential for several future projects to be undertaken. These projects, which, if constructed, include: (1) development, construction and installation of a sewer line from the Milton Street WWTF to the Town of Chemung; (2) development, construction and installation of a municipal water line from Wellsburg, New York to the Town of Chemung and which may include development, construction and installation of a water storage tank in the hamlet of Chemung; (3) development, construction and installation of a landfill gas–to–energy system to consist of a gas–to–energy facility at the Milton Street WWTF, an initial gas treatment facility at the landfill and a landfill gas transmission line from the landfill to the Milton Street WWTF; (4) development, construction and installation of a hydroponics greenhouse for the purpose of growing agricultural products; (5) development, construction and installation of an enhanced construction and demolition recycling facility at the Lake Street Facility; (6) development, construction and installation of a sustainable environmental economic development center for environmental stewardship; (7) partial funding of a career development center to be located within Chemung County and (8) possible future landfill expansion.

Monroe County – The Board of Education of the Penfield Central School District, as lead agency, has determined that the proposed district–wide additions and alterations to Penfield Central School District buildings and facilities may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The scope will also be posted on the District’s Website for public review and copies to all interested and involved agencies will be provided. Written comments on the draft scoping outline will be accepted until 4:30 p.m. on August 24, 2005. The action involves:

Notice Of Public Hearing

NOTICE OF PUBLIC HEARING CONCERNING THE DRAFT ENVIRONMENTAL IMPACT STATEMENT RELATING TO A DEEP WATER ALUM APPLICATION IN HONEOYE LAKE

NOTICE IS HEREBY GIVEN that a public hearing pursuant to the New York State Environmental Quality Review Act and its implementing regulations found at 6 NYCRR Part 617 (hereinafter collectively referred to as 'SEQR') will be held by the Ontario County Planning Department at the Honeoye Central School, 8528 Main St, Town of Richmond, Honeoye, New York, on the 31st day of August, 2005, at 7:00 PM to receive comments concerning the Draft Environmental Impact Statement (DEIS) prepared concerning a deep water Alum Application in Honeoye Lake. The proposed Alum Application in Honeoye Lake involves the application of approximately 120,000 gallons of liquid alum to the deep water area (an approximately 800 acre area of 20 feet or greater water depth) of Honeoye Lake in April of 2006. The intention of the application is for the alum to settle to the lake bottom and tightly bond with phosphorus in the bottom sediments to prevent the release of phosphorus into the lake water, especially when the deep water experiences anoxia during the summer growing season. This is intended to mitigate mid and late summer algal blooms that have historically occurred in Honeoye Lake. The action requires funding from local municipal sources, local project administration, coordination with law enforcement agencies to limit access to the lake during the application, and a State Pollution Discharge Elimination System permit from the New York State Department of Environmental Conservation.

All persons wishing to appear and be heard at such hearing may do so in person or by attorney or other representative. Written comments may be submitted until 5:00 PM in the office of the Ontario County Planning Department on September 15, 2005, or submitted at the time and place of the public hearing. Copies of the DEIS prepared for this project may be viewed in the Ontario County Planning Department during regular business hours which are 8:30 AM through 5:00 PM, Monday through Friday. The DEIS will also be available at the Honeoye Library (located at 8708 Main St., Honeoye, NY 14471, Monday & Thursday 2:30 PM - 8:30 PM, Tuesday 10:00 AM - 8:30 PM, Saturday 10:00 AM - 1:00 PM) and at the office of the Town of Richmond Town Clerk (located at 8690 Main St., Honeoye, NY from 9AM-5PM Monday - Friday and 9AM - Noon Saturdays).
