The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27–1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Nassau County – The Nassau County Planning Commission as agent for the Nassau County Legislature, as lead agency, has determined that the proposed Conveyance of former County Sewage Disposal Facility in Inwood will not have a significant adverse environmental impact. The action involves solicitation by Nassau County of proposals for the conveyance of County owned property, (formerly used as a County Sewage Disposal facility), currently used for industrial purposes. The project is located on the access road off of Incinerator Road, west of Rockaway Turnpike, Inwood, Town of Hempstead.

Nassau County – The Town of Oyster Bay, as lead agency, has determined that the proposed Petition of Waterworld Realty, LLC. and Spin Super Laundromat, LLC. for a Special Use Permit may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves a Special Use Permit to use an existing building for a laundromat. The project is located at 40 Carmans Road, Massapequa, Town of Oyster Bay, NY.

Notice Of Acceptance Of Final Generic EIS

Suffolk County – The Town of Brookhaven Town Board, as lead agency, has accepted a Final Generic Environmental Impact Statement on the proposed Adoption of a Local Law to enable the Transfer of Development Rights. Adoption of a Local Law Creating a Multifamily Residential District (MF), Planned Retirement Community (PRC) Residence District and Planned Retirement Congregate Housing Community (PRCHC) Residence District and various other zoning code amendments. The action involves the proposed Zoning Amendments.

Final Generic Environmental Impact Statement

Lead Agency: Planning Board of the Town of Babylon

Name of Action: Deer Park Enterprises (Tanger) Planning Board Job No. 2004–11AFN.

The public comment period has been extended by the Lead Agency and comments are requested and will be accepted by the contact person until August 18, 2005.

Description of Action: Retail development on 81 acre Ga Industrial site which includes the demolition of existing structures, approximately 805,159 square feet of proposed building area, 4,723 parking stalls and associated site improvements. Note: Project has been reduced in scope by 89,385 square feet of retail space, B.J.’s Warehouse and gasoline service station have been removed and need for 357 parking space variance eliminated.
