The
Department of Environmental Conservation (DEC) has undertaken a full and
complete technical review of this State Pollutant Discharge Elimination System (SPDES)
permit, in accordance with the Environmental Benefit Permit Strategy (EBPS.) DEC has
made a tentative determination to re-issue/re-new this pre-existing Industrial SPDES
permit for a five year term with only minor modifications in formatting and updates to
bring the permit into currency. This permit involves the surface discharge of treated
stormwater and hydrostatic test water in a maximum amount of 100,000 gallons per day
to the Gowanus Canal. All effluent limitations and reporting requirements have remained
stringent and unchanged.
Additional
information on this permit may be requested from or inspected at the
NYSDEC Central Office in Albany. Substantive comments must be submitted in writing
to the contact person. To be called substantive, 6 NYCRR Part 621.7 requires public
comments "explain the basis of opposition and explain specific grounds..." for
opposition.

The Department has made
a tentative determination to approve an application for an
existing facility currently permitted as a Title V facility. The applicant has applied for an
Air State Facility permit for their manufacturing and asphalt recycling facility. In order to
avoid Title V applicability and NOX-RACT controls required under Part 227-2, the
owner has applied for a cap on its asphalt production and on the annual use of diesel oil.
The application, draft permit, relevant supporting materials and regulations are available
for review during normal business hours at the DEC office provided in this notice.
Comments of support or objection may be made by filing a written statement by the
deadline date indicated. DEC may schedule a public hearing based upon an evaluation of
the nature and scope of any written objections raised. Hearing notices will contain
instructions on filing for party status and submitting comments.
