The Department has prepared
a Draft Permit pursuant to Article 19 (Air Pollution
Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal
Clean Air Act Amendments and made a tentative determination to approve the
modification application for the applicant's Morton Salt Division facility located at 45
Ribaud Avenue, Village of Silver Springs, Town of Gainesville, Wyoming County. The
facility operates a 92.5 mmBtu/hr auxiliary, natural gas fired boiler used to produce
steam in support of the main coal fired boiler. Morton Salt is proposing to change the
method of operation of the gas boiler which will affect the applicability to 6NYCRR Part
227-2 and New Source Review, as follows: (1) In 1996, the facility established a
variance from the Part 227-2 Nitrogen Oxide (Nox) Reasonably Available Control
Technology (RACT) requirements on the gas boiler by limiting the operation of the boiler
to 500 hours per any 12 month period. Morton Salt is proposing to remove the 500 hour
operational limit on the boiler and comply with the Nox RACT emission limit of 0.10
pounds Nox per million Btu (lb Nox/mmBtu). (2) Based on a New Source Review
analysis, Morton Salt is accepting a limit on the Nox emissions to remain below the
significant net emissions increase threshold of 40 tpy. Morton Salt will limit the project's
potential Nox emissions at 38.8 tpy by operating the source less than 8400 hours during
any 12 month period. As such, the proposed project will be in compliance with Part 227-2 and will
not be subject to New Source Review. In accordance with 6NYCRR Parts
621.5(d)(9) and 201-6.4(c), the Administrator of the United States Environmental
Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility
Permit if it is determined not to be in compliance with applicable requirements of the
Clean Air Act or 6NYCRR Part 201. Persons wishing to inspect the subject Title V files,
including the application with all relevant supporting materials, the draft permit, and all
other materials available to the DEC (the "permitting authority") that are relevant to this
permitting decision should contact the DEC representative listed below. It is
recommended that an appointment be made to confirm the availability of the subject files.
The DEC will endeavor to make the files available within 2 business days of contact,
during normal business hours (8:30 am through 4:45 pm), unless the requester wishes to
inspect the files at a later date. Comments of support or objection may be made by filing a
written statement by the deadline date indicated. The Department may schedule a public
hearing based upon an evaluation of the nature and scope of written objections raised.
Hearing Notices, if necessary, will provide instructions on filing for party status and
submitting comments. Following the 30 day comment period, the EPA will have an
additional 45 days to review the draft or modified draft permit. If the EPA does not raise
any objection in that time, the Department may then issue the final draft permit as the
Title V Permit.
