Negative Declaration

Cattaraugus County – The Olean Common Council, as lead agency has determined that the proposed Adoption of Comprehensive Development Plan 2005-2025 will not have a significant adverse environmental impact. The action involves adoption of Comprehensive Development Plan (CDP) for the City of Olean. The CDP identifies the major issues facing the community and articulates a long term vision to is future growth and development. It outlines community goals and policies developed to guide policy making for the City over the next 5–10 years that are designed to assist in evaluation land use and development proposals as well as to recognize resources to protect and enhance in the community. The CDP also states its general plans for open space, conservation and recreation facilities and community services such as policy, fire and ambulance services, etc. and City facilities. The concluding part of the Plan recommends a series of action steps that can move the City of Olean forward and achieve the goals and objectives agreed upon.

Chautauqua County – The Forestville Central School District’s Board of Education, as lead agency, has determined that the proposed improvements at the High School (SED Project Control No. 06-15-03-04-0-002-006) will not have a significant adverse environmental impact. The action involves an approximately 25,000 sq .ft. addition (to an existing 73,000 sq. ft. building) for cafeteria/kitchen expansion, new music suite and toilet room, and new main entry and auditorium. Interior renovations include improvements to the kitchen, meal serving space, office area, nurse‘s area, guidance area, and art, science and special education rooms. Technology upgrades will also be included. Exterior work includes sidewalk improvements. The District is also considering purchasing approximately 13.5 acres adjacent to the Elementary/High School complex on Water Street for the purpose of constructing an approximately 15,000 sq. ft. new bus garage (SED Project Control No. 06–15–03–04–5–004–002). The new structure would be a pre–engineered metal building and would house up to 16 full size buses. Related improvements would include paving for driveway, turnaround, and parking areas.

Erie County – The Town Of Amherst Planning Board, as lead agency, has determined that the proposed Amended Dockside Village Apartment Complex will not have a significant adverse environmental impact. The action involves an amendment to the previously approved Dockside Village Apartment Complex to be located at 10750 Transit Road, Town of Amherst. The apartment development is one component of the larger Dockside Village development which encompasses 274± acres and is located on the west side of Transit Road, 1,250± feet north of Dann Road. A Lead Agency coordination letter was previously issued on February 6, 2002 for the initial Dockside Village road and utilities, apartment complex and open development area for the Dockside Village subdivision. The current site plan reflects the amended apartment complex which will now utilize a newly rezoned parcel of land consisting of 3.82± acres. The apartment development has been increased to a total of 184 units and 519± parking spaces. The petitioner is Sutton Lake Estates LP, 7 Van Auker Street, Rochester, NY. The action involves the expansion of an existing 20,529± sq. ft. office/manufacturing building with a 15,000± sq. ft. addition to the back of the building. No new parking spaces are proposed. Erie County – The Town Of Amherst Town Board, as lead agency, has determined that the proposed Rezoning – 6330–6350 Main Street (portions of) & 6380 Main Street will not have a significant adverse environmental impact. The action involves the rezoning of 43.3± acres of a total 47± acre site located at 6330–6350 Main Street & 6380 Main Street, Amherst, New York (Z–5–05).

The subject property is located on the north side of Main Street (NYS 5), 1,100± feet east of Youngs Road, and extends behind the existing Unitarian Universalist Church, the Gateway Youth Center and the existing Village Park Business Center. The rezoning of the 43.3± acre property consists of the following: 30.18± acres from Community Facilities (CF) to Multi–Family Residential District – Four A (MFR–4A); 5.03± acres from CF to General Business (GB); 3.57± acres from CF to Office Building (OB); 2.329± acres from Multi–Family Residential District – Seven (MFR–7) to OB; and 2.213± acres from MFR–7 to OB. The petitioner proposes to develop a maximum of 139± patio homes, a mixed–use commercial complex along the Main Street frontage, and the reconfiguration of 484± parking spaces for the existing Village Park Business Center.
