Project Description:
The Department has received an application for the modification of the above referenced wastewater discharge permit for the Penn Can Asphalt Materials facility located at 300 Cole Road in the Town of Lyons. This facility is used for the blending and storing of asphalt bitumuls and asphalt cement. The proposed modification includes the relocation of Outfall 001 300 feet north of its current location and an enlargement of the facility's secondary containment system. The enlargement of this system will result in an increased discharge of stormwater from Outfall 001. The total annual discharge is proposed to increase from 2.54 million gallons to 3.1 million gallons. This represents an increase in the average daily flow of 1,000 gallons per day. This outfall discharges to the NYS Barge Canal, a class C waterbody. No change in parameters, effluent limits or monitoring requirements is proposed in this modification. The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comments prior to making a final decision on permit issuance. A draft permit is available for review.

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency:
None Designated
State Historic Preservation Act (SHPA) Determination:
A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
