The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application. The applicant has applied for a permit modification and
emission reduction credits (ERC) for VOC and NOx as per 6 NYCRR Part 231-2.6. The
facility discontinued using boiler No. 1, (emission unit 0-00001, emission source 00001)
on 11/30/02 and derated boiler No. 4 (Emission source 00004) from 129 mmbtu/hr to 97
mmbtu/hr. The facility-wide emissions of NOx and VOC are limited at 50.6 tpy and 0.35
tpy respectively by limiting the fuel usage to 2,500,000 gpy. Based on these changes, the
facility has requested emission reduction credit for VOC and NOx, 0.10 tpy and 22.4 tpy
respectively. Also the facility derated boiler No. 4 (emission source 00004) and has
requested permit condition modification since this boiler meets the NOx emission limit
(verified by a stack test conducted in 2004).
In accordance with 6NYCRR
Parts 621.5(d)(9) and 201-6.4(c), the Administrator of the
United States Environmental Protection Agency (USEPA) has the authority to bar
issuance of any Title V Facility Permit if it is determined not to be in compliance with
applicable requirements of the Clean Air Act or 6NYCRR Part 201.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting materials, the draft permit, and all other materials available to the
DEC (the "permitting authority") that are relevant to this permitting decision should
contact the DEC representative listed below. It is recommended that an appointment be
made to confirm the availability of the subject files. The DEC will endeavor to make the
files available within 2 business days of contact, during normal business hours (8:30 am
through 4:45 pm), unless the requestor wishes to inspect the files at a later date.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative public hearing is a proceeding which provides an additional opportunity for
public comment. DEC's determination to hold a legislative public hearing will be based
on whether a significant degree of public interest exists. If a legislative public hearing
is
to be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and
requests for a legislative public hearing should be in writing and addressed to the
Department representative listed below.
An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to
the Environmental Conservation Law exist. A copy of the Department's permit hearing

The Department has made
a tentative determination to approve a permit modification for
an existing facility for the installation and operation of sewage pump around engine-generators and
associated sewage pumps at this facility. This consists of two engine-
generators in Phase I (by 8/05) and two more engine-generators in Phase II (by 5/06).
Each engine will be directly associated and connected to a main sewage pump for the
plant's sewage pump around operation. Exhaust will be treated with Selective Catalytic
Reduction (SCR) after combustion-treatment system in order to meet Part 227 NOx
RACT requirements. Phase I engines will only operate as a power source when the usual
supply of power is unavailable. The facility is capping our of New Source Review at 22.5
tons per year of NOx per 6 NYCRR 201-7. Phase I engines will be removed once two
permanent back-up engine-generators under Phase II are ready to operate (5/06). The
application, draft permit, relevant supporting materials and regulations are available for
review during normal business hours at the DEC office provided in this notice.
Comments of support or objection may be made by filing a written statement by the
deadline date indicated. DEC may schedule a public hearing based upon an evaluation of
the nature and scope of any written objections raised. Hearing notices will contain
instructions on filing for party status and submitting comments.

The Department has made
a tentative determination to approve this application for a new
permit for a proposed discharge of varying amounts per day of treated and untreated
groundwater into Thurston Basin (Class I) via Outfall JAM-007, Bergen Basin (Class I)
via Outfall JAM-006 and groundwater from fifteen well stations and four tanks of the
Jamaica Water Supply System located throughout Southeast Queens that are connected to
storm sewers. The discharges are required for general maintenance and operation of the
water supply system. A draft permit is available for inspection and comment at the
regional office. The permitted discharges will include Start-Up/Routine Maintenance,
Sampling, Disinfection, GAC Unit Start-Up, and Tank Operations.
