THIS IS A REVISION AND RE-NOTICE
OF A NOTICE OF COMPLETE
APPLICATION ORIGINALLY DATED NOVEMBER 22, 2004.
The
Palumbo Sand and Gravel Company proposes an 18-acre downward
expansion into groundwater in order to mine from 30 to 55 feet below the current mine
floor, within the eastern half of their currently approved sand and gravel mine. The 18-acre area
would be located a minimum of 200 feet from the east bank of the Swamp
River. It would allow excavation of approximately 1,000,000 cubic yards of sand and
gravel over approximately 10 years, for processing at the Company’s existing processing
facility and sale to customers.
Mining
to this depth will result in mining below the groundwater table, which is
estimated to be at least 5 feet below existing floor of the mine. Reclamation of this 18-acre
excavation would be to create an 18-acre lake. This area is outside the 100-year
floodplain and is also separated from the Swamp River by a vegetated berm, ranging in
height from 4 to 8 feet high and from 30 to 40 feet wide at its base, which parallels the
Swamp River along the full length of the 18-acre excavation area. The resulting sand and
gravel would continue to be trucked over the Company’s existing bridge on the Swamp
River to be processed at the Company’s existing processing facility. Blasting will continue
to be prohibited at the site.
This
proposed 18-acre modification to the Company’s mining and reclamation plan is
located within the 92-acre area currently mined by the Company under a Mined Land
Reclamation permit at the intersection Sherman Hill Road and NYS Rt. 22 in the Town
of Dover, Dutchess County.

The
applicant, Somers Chase Waterworks Corp., has applied for a Water Supply
permit to develop one new well, known as Well #3, to be pumped at a rate of 30 gallons
per minute (gpm), to serve the approximately 99 homes in the Kenilworth Subdivision.
Well #3 is a 500 foot deep, bedrock well, with steel casing down through the first 72 feet
to prevent surface waters from draining into the aquifer. The applicant submitted the
results of a 72 hour pumptest, which showed that the well can safely produce 30 gpm.
This well would be combined with the applicant's existing Well #1 rated at 50 gpm and
Well #2 rated at 90 gpm. All three wells would be managed together to produce an
average of 61 gpm, which is the equivalent of 88,200 gal. per day.
The
applicant is also proposing to construct a 2000 foot long pipeline to pump the
water back to the main wellfield. A portion of the pipeline would be through the 100-foot
wide adjacent area of state regulated Freshwater Wetland #F-76 (Class 2) and under a
culvert containing Hallocks Mill Brook [Class B-ts].

#3 is located just off Hallock's Run Road near the intersection of Voris Drive,
in the Kenilworth Subdivision, in the Lincolndale section of the Town of Somers,
