The applicant proposes to
construct two new stream crossings and a stormwater detention
basin outfall within a tributary of Masonic Creek (DEC Water Index No. H-139-13-51-3a; Class B)
associated with construction of a 192-unit apartment complex. The project
site is located on the northeast side of Tower Drive, approximately 0.4 mile southeast of
the intersection with Scotchtown Road. The proposed crossings are each about 25 feet
wide, and will involve a total stream disturbance of approximately 130 linear feet. The
remainder of the work will involve an additional 330 linear feet of the stream bank
disturbance for regrading and installation of a stormwater outfall.

The Department of Environmental
Conservation has initiated a modification of the State
Pollutant Discharge Elimination System (SPDES) permit for the City of Kingston Sewage
Treatment Plant (STP.) This modification is undertaken pursuant to 6 NYCRR Part 1.18,
New York State’s Environmental Benefit Permit Strategy (EBPS). The following
changes to the permit have been proposed:
Permit pages -
Updated permit pages are
used, based on current Department guidance, format and
nomenclature.
Permit pages are renumbered
and reordered.
The address for the Bureau
of Watershed Compliance and Ulster County Department of
Health on the Recording, Reporting and Monitoring page have been updated.
A continuation of the Discharge
Notification Act requirements was added.
The pretreatment program
language has been updated to require continuation of the
program and annual reporting.
A required Tier 2, Chronic
Toxicity Testing and Toxicity Reduction Evaluation
Compliance Schedule have been added to the permit.
CSO (Combined Sewer Overflow)
outfalls 003, 004, and 008 have been eliminated as
part of the CSO program. These outfalls have been removed from the permit.
The CSO BMP (Best Management
Practices) language has been updated to include all 15
BMP’s along with the LTCP (Long Term Control Plan) requirements in accordance with
EPA’s national CSO control policy and the wet weather water quality act of 2000.
Permit Limits, Levels
and Monitoring -
Mass limits -
Mass limits for UOD, CBOD5 and TSS were rounded to 2 significant
figures in compliance with DEC guidance in the DMR Manual for Completing the
Discharge Monitoring Report for the SPDES, NYSDEC, February, 2002.
Removed parameters-
The limits for cadmium and action levels for antimony, nickel,
mercury and xylenes have been removed from the permit as these parameters have not
been detected in the effluent over the past three years.
Lead study- The quantification
and removal study for lead was completed and therefore
the requirement was removed from the permit.
Added parameters
- Limits for copper and lead have been added to the permit as these
parameters have been detected in the effluent over the last three years.
Monitored parameters
- Zinc was changed from action level to monitoring 1 /quarter
because of very low effluent levels.
Phenolics monitoring
- A hi-intensity phenolics monitoring schedule has been added to
the permit. Sampling will be required 1/week for a period of 3 months to gather data to
determine whether phenolics are consistently present in effluent and need to be limited.
Mercury monitoring
- A hi-intensity mercury monitoring schedule has been added to
the permit. Sampling will be required 1/month for a period of 3 months to gather low
level mercury data using EPA Method 1631.
Sewer system evaluation
study - A sewer system evaluation study compliance action
has been added to the permit specifically targets sewers that have experienced
deterioration and to rehabilitate the sewers that require work.
Plant flow diagram
- A new plant flow diagram has been added to the permit.
Influent Sampling
- The influent sampling requirements for 7-day average CBOD5, 7-day average TSS, TKN, fecal coliform, pH, and temperature have been removed from the
permit, as the information is no longer necessary.
