The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

Please note the application package includes the Remedial Draft Investigation Work Plan which describes the remedial activities to be conducted to investigate and determine the nature and extent of the contamination related to the site.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Erie County - The Buffalo Urban Renewal Agency, as lead agency, has determined that the proposed Health Now Headquarters Project will not have a significant adverse environmental impact. The action involves construction of a new approximately 451,000 square foot commercial building. The project will also involve the following: construction of a five story parking garage and a surface parking lot for a total of approximately 1,600 vehicles, adjacent to the project site; property acquisition; adoption of an amendment, by the Ciy of Buffalo, to its existing Waterfront Urban Renewal Plan to change the allowable use of the Office Building Site from Multi-family to Commercial; construction of a new 16,000 square foot day care facility, with an adjacent parking lot for approximately 50 vehicles, on a portion of vacant BURA owned land adjacent to the Waterfront school.

Niagara County - The City of Niagara Falls Planning Board, as lead agency, has determined that the proposed Military Road Retail Center will not have a significant adverse environmental impact. The action involves a subdivision and site plan approval for the development of approximately 516.627 sf of commercial uses on an approximately 53 acre site. Site variances and special use permit approvals for automotive services. Zoning and sinage amendments for retail shopping centers. The project is located at 1500 Military Road, Niagara Falls, NY.

Notice Of Acceptance Of Draft Generic EIS And Public Hearing

Erie County - The Town of Tonawanda Town Board, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed Riverview Commerce Park. A public hearing on the Draft Generic EIS will be held on July 18, 2005 at 7:00 p.m. at the Town of Tonawanda Town Hall, 2919 Delaware Avenue, Kenmore, New York. Written comments on the Draft GEIS are requested and will be accepted by the contact person until August 1, 2005. The action involves three (3) parcels of land totaling 106 acres. The proposed development of this property includes commercial businesses and warehouses from the northern limits at the frontage of River Road (State Route 266) to the southern limits at the powerline access easement. 42 percent of the 106 acres will consist of roads, buildings, and other paved surfaces. 50 percent will consist of remaining mature trees of aesthetic value and revegetation. The remaining 8 percent are wetlands that are scheduled for protection under engineering controls. The project is located at 5201 River Road, in the Town of Tonawanda.
