AKZO NOBEL SALT CO.,
INC. (“Akzo” or “Applicant”) has applied for well permits and a
variance to the well location requirements set forth in Title 6 of the Official Compilation of
Codes, Rules and Regulations of the State of New York (“6 NYCRR”) Section 553.2 to drill two
observation wells within 30 and 40 feet of the traveled part of Jones Bridge Road in the Town
of
Leicester, Livingston County, New York. The Applicant proposes to drill, complete and test the
wells, but needs a variance from the well location provisions set forth under 6 NYCRR §553.2.
In accordance with 6 NYCRR §553.2, all wells regulated by the Department must be located
at
least 75 feet of the traveled part of a roadway.
The Department of
Environmental Conservation (“Department”) and the Applicant have agreed
to a Stipulation which resolves issues pertaining to the application for a well location variance
and the establishment of procedures for the protection of public safety as a result of the
observation wells’ locations. This Stipulation is binding on the Applicant. In view of the
proposed Stipulation, the Department supports the granting of the requested variance and
issuance of well drilling permits for both observation wells.
The public comment
period will remain open until SATURDAY, July 2, 2005. Written

The applicant proposes a
+/-100 l.f. sheet steel refacement of an existing, deteriorated
fueling dock at the Riverview Yacht Basin. A barge mounted crane will be used to
handle construction materials and drive the new sheet piles. The existing structure will
be braced and tied back to the riverbank. The refacement will be backfilled with crushed
stone and concrete and the concrete dock pads will be re-set. The project site is the
Riverview Yacht Basin on the west bank of the Genesee River, approximately 3000 ft.
south of the Stutson Street bridge.

Steuben County Department
of Public Works proposes to build a new concrete bridge
over the Canisteo River to replace an existing bridge #65-2. It will be located on Route 65
in the Town of Hornellesville, just southeast of the existing Route 65 bridge.
Construction of the new bridge will be done behind coffer dams of a non erodible
material. The existing bridge will be removed after the new bridge is completed.

The applicant proposes the
dredging of approximately 3600 cubic yards of contaminated
sediment from the Seneca Lake Sonar Test Facility lagoon in Dresden. Sediment
deposition has reduced the water level in the lagoon to a depth that is unsafe for operating
the facility's vessels. Samples collected from the proposed dredging areas show that the
material is contaminated generally with low levels of metals and polycyclic-aromatic
hydrocarbons and is not considered hazardous. Dredge spoils will be beneficially used as
daily landfill cover at a Department permitted Part 360 landfill under a predetermined
Beneficial Use Determination (BUD). The water resulting from the sediment dewatering
process will be sent to a Publicly Owned Treatment Works (POTW). Additionally, 584
linear feet of sheet piling will be installed to stabilize the lagoon shoreline.
