This Department has received
a request to renewal a permit and has drafted an Article 19
(Air Pollution Control)
of the Environmental Conservation Law, an Air Title V Permit, at
the facility located at Dominion Transmission Inc.-Utica Station, the facility located at
Higby Road, Frankfort, NY 13340.
The Department has made
a tentative determination to approve the application of the
Dominion Transmission Inc., which provides for the transmission of natural gas along the
natural gas pipeline. The renewal of the Title V Permit allows the operations and
modifications of emission units 0-0000A, 0-0000B, 0-0000C, and 0-0000D, which
includes Five Copper GMVC-6 internal combustion engines, one Cooper GMVH-10C2
internal combustion engine, one Waukeshau H24Gl auxiliary generator, and one
Kewanee KR8-G-07 auxiliary boiler. The modifications are being conducted with respect
to the new 6 NYCRR Part 227 NOx RACT requirements and will be conducted as
described in a table submitted in an approved Compliance and Operating Plan submitted
in May 2004.
Persons wishing to inspect
the subject Title V files, including the application with all
relevant supporting materials, the draft permit, and all other materials available to the
DEC(the "permit authority") that are relevant to this permitting decision should contact
the DEC representative below. It is recommended that an appointment be made to
confirm the availability of the subject files. The DEC will endeavor to make the files
available within two business days of contact, during normal business hours (8:30 am
through 4:45 pm), unless the requester wishes to inspect the file at a later date.
DEC will evaluate the application
and the comments received on it to determine whether
to hold a public hearing. A public hearing may be legislative or adjudicatory. A
legislative public hearing is a proceeding which provides an additional opportunity for
public comment. DEC's determination to hold a legislative public hearing will based on
whether a significant degree of public interest exists. If a legislative public hearing is to
be held, a Notice of Hearing will be published which will include the time and place of
the hearing and submitting comments. The applicant and all persons who have filed
comments on the permit will be notified by mail of the public hearing. Comments and
request for a legislative hearing should be in writing and addressed to the Department
representative listed below.
An adjudicatory public hearing
is a trial type proceeding which provides the opportunity
for adjudication on the basis of evidence, including direct testimony and cross
examination. An adjudicatory hearing is held only if substantive and significant issues
relating to any findings or determinations the Department is required to make pursuant to
the Environmental Conservation law exists. A copy of the Departments permit hearing
procedures is available upon request or on the Department's web site at:

In accordance with 6NYCRR
Part 621.5(d)(9) and 201-6.4(c), the Administrator of the
Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title
V Facility Permit if it is determined not to be in compliance with applicable requirements
of the Clean Air Act or 6NYCRR Part 201. After the public comment period, the USEPA
will be provided a proposed permit and will have an additional 45 day period for review.
If USEPA does not raise any objection, the Department will issue the permit. The
application and Draft Title V Facility permit are available in the Region 6 NYSDEC
office in Watertown, New York.

intersection. No on-site processing is proposed. The purpose of the mine is to support
construction of the Maple Ridge Wind Farm Project (formerly Flat Rock Wind Power
Project). The project is expected to last two years, after which the site will be returned to
an open field condition.

This draft permit is Department-initiated
modification, undertaken pursuant to 6NYCRR
Part 750-1.18(a)(6) & (7). The following changes have been made to the permit:
Permit pages were updated. All the seasonal limits are included on page 3 of the permit. The requirement to report influent 7-day averages was removed as only the monthly influent values are needed for calculation of percent removal. The flow limit was changed from a monthly average limit to a twelve-month rolling average limit in accordance with Department guidance for combined sewer overflow permittees. The Best Management Practices language was updated. The annual BMP report is to be submitted to both the Regional Water Engineer and the Central Office and the minimum flow through the plant headworks was changed from 3.67 mgd to 4.0 mgd, based on information from the permittee. A requirement to develop a Long-Term Control Plan for Combined Sewer Overflows was added in accordance with EPA’s National CSO Control Policy and the Wet Weather Water Quality Act of 2000. The person responsible for submission of monthly Discharge Monitoring Reports was changed to the current chief operator. The requirement to continue to maintain the outfall sign under the Discharge Notification Act was included in the permit. |
