NOTICE OF STATE POLLUTANT DISCHARGE ELIMINATION SYSTEM (SPDES)
P/C/I GENERAL PERMIT RENEWAL
GP-0-05-001

The New York State Department of Environmental Conservation (DEC) has renewed the General Permit (GP) for minor sanitary wastewater discharges to groundwater under the State Pollutant Discharge Elimination System (SPDES) program. The GP (formerly GP 95-01) has been retitled GP-0-05-001 and shall be effective from May 11, 2005 to May 10, 2015. General Permit 0-05-001 will authorize the subsurface discharge of sanitary waste, without the admixture of industrial wastes, from Private/Commercial/Institutional (P/C/I) facilities between 1,000 and 10,000 gallons per day. Exclusion criteria are contained in the permit identifying these areas in which use of the GP is not permissible. All permittees currently authorized under GP 95-01 shall be permitted to discharge under GP-0-05-001 and shall be considered authorized without interruption. 6 NYCRR Part 200, General Provisions

Pursuant to Environmental Conservation Law, Sections 3-0301, 19-0301, 19-0303, and 72-0303, the New York State Department of Environmental Conservation hereby gives notice of the following:

NOTICE OF ADOPTION OF RULE on April 12, 2005, to be effective May 29, 2005, amendments to 6 NYCRR Part 202, Emissions Verification, and 6 NYCRR Part 200, General Provisions.

The adoption of this rule is intended to revise the emission statement rule to reflect the requirements of EPA's Consolidated Emission Reporting Rule and align emission reporting requirements under Subpart 202-2 with the operating permits issued to facilities pursuant to Part 201. The rule will incorporate new EPA test methods and streamline emission reporting procedures in Subpart 202-1. As part of this rulemaking, Part 200 will be amended to add new definitions, revise the Volatile Methyl Siloxanes table, and update cross references in section 200.9.

Notice of Proposed Rulemaking

New York State Department of Environmental Conservation
6 NYCRR Part 218, Emission Standards for Motor Vehicles and Motor Vehicle Engines, and 6 NYCRR Part 200, General Provisions

Pursuant to Environmental Conservation Law, Sections 1-0101, 3-0301, 19-0103, 19-0105, 19-0107, 19-0301, 19-0303, 19-0305, 71-2103, and 71-2105, and section 177 of the Federal Clean Air Act, the New York State Department of Environmental Conservation hereby gives notice of the following:

Proposed amendment of 6 NYCRR Part 218, Emission Standards for Motor Vehicles and Motor Vehicle Engines, and 6 NYCRR Part 200, General Provisions to incorporate revisions California has made to its vehicle emission control program regarding reduction of greenhouse gas (GHG) emissions from motor vehicles, and to otherwise update various incorporation by reference citations included in the LEV program.

This amendment was proposed and filed with the Department of State on the 28th day of April, 2005. The Notice of Proposed Rulemaking will be published in the May 18, 2005 issue of the State Register.

Hearing Notice

STATE OF NEW YORK
DEPARTMENT OF ENVIRONMENTAL CONSERVATION

Notice is hereby given that the New York State Department of Environmental Conservation (Department), will hold legislative public hearings on amendments to proposed rules, Part 218, Emission Standards for Motor Vehicles and Motor Vehicle Engines, and Part 200, General Provisions, pursuant to Environmental Conservation Law, Sections 1-0101, 3-0301, 19-0103, 19-0105, 19-0107, 19-0301, 19-0303, 19-0305, 71-2103, and 71-2105 and Section 177 of the Federal Clean Air Act.

Part 218 will be revised to reflect changes to California’s existing Low Emission Vehicle (LEV) program that incorporated Greenhouse Gas (GHG) emission reduction standards for light and medium-duty vehicles, and to maintain identical standards with California for all vehicle weight classes as required under Section 177 of the Clean Air Act. Subpart 200.9 will also be revised in order to reflect updates to the referenced material incorporated in the Part 218 revisions. Adoption of these modifications is necessary to reduce emissions of air contaminants from new motor vehicles, and will also provide for continuing advancement of motor vehicle emissions control technology.

The Department will provide interpreter services for deaf persons at no charge. Pursuant to Part 617 of the implementing regulations for the State Environmental Quality Review Act, the Department has prepared a Negative Declaration stating that the proposed actions will not have a significant adverse effect on the environment.

The Department invites all persons, organizations, corporations, and government agencies that may be affected by the proposed revisions to attend the hearings. At each hearing, persons who wish to make a statement will be invited to speak. It is requested that oral statements also be submitted in writing. The Department will give equal weight to written and oral statements, and since a cumulative record will be compiled it is not necessary for interested parties to attend each hearing.
