The applicant proposes a
subsurface discharge of 22,000 gallons per day of treated (septic
tank/tile field) wastewater from the appicant's new Public Safety Facility located on the
east side of NYS Route19, approximately 3,000 feet southwest of the Village of
Belmont. The New York State Department of Environmental Conservation (Department)
has made a tentative determination to issue a State Pollutant Discharge Elimination
System (SPDES) permit under Article 17 of the Environmental Conservation Law for this
discharge. This tentative determination indicates that the discharge regulated under this
statute is considered to satisfy regulatory standards for permit issuance, based on
information available to the Department at this time. The application and draft permit,
containing Department proposed effluent limits and monitoring requirements, are
available for public inspection at the Department's Region 9, Allegany Office. As a
tentative determination, the Department seeks comments on the proposed regulated
activity prior to making a final decision on permit issuance. As such, this tentative
determination does not signify Department approval for or endorsement of the activity for

The town proposes to excavate
its gravel pit a maximum of 12 feet deeper. Following
excavation, replacing overburden and topsoil will raise the final elevation 2 feet. This
will leave a bowl-shapeed area with the highest slopes at the southeast corner and
matching the existing undisturbed ground elevation at the northwest corner. Reclamation
will result in a grassy meadow. The mine site is adjacent to the town barn, east of
Allegany Road, about 0.34 miles north of NYS Route 242.

Department of Environmental Conservation (DEC) has received an application to
re-issue/re-new the following pre-existing EPA minor Private/Commercial/Institutional
State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a
tentative determination to re-issue/re-new this pre-existing permit for a five year term
maintaining current effluent limitations and monitoring and reporting requirements. This
permit involves the surface discharge through a sand filter of up to 1,000 gallons per day
of treated sanitary waste to a tributary of the Stillwater Creek.
Additional
information on this permit may be requested from or inspected at the
NYSDEC Central Office in Albany. Substantive comments must be submitted in writing
to the contact person. To be called substantive, 6 NYCRR Part 621.7 requires public
comments "explain the basis of opposition and explain specific grounds..." for
opposition.
