Pursuant to the Environmental Conservation Law §§ 1-0101, 3-0301, 9-0105, the Department of Environmental Conservation hereby gives notice of the following:

Proposed Rule-making for 6NYCRR Section 190.13 relating to the use of bear resistant canisters in Wilderness areas in the Adirondack Park. This notice will be published in issue 20 of the State Register, dated 5/18/2005.

Project Title: Grogan Knolls

Location: NYS Route 28, Town of Johnsburg, Warren County

Project Description: The project is the subdivision of 40.96± acres into seven lots thereby creating six new building lots (4 lots ranging in size from 1.42± to 2.72± acres, an 11.86± acre lot and a 19.18± acre lot) and a 1.14 acre parcel containing a proposed subdivision road. One new single family dwelling with on-site water supply and wastewater treatment systems is proposed for each of the six new building lots. Access to the lots is to be from a 783± ft. long subdivision road located within the 1.14± acres road parcel. Individual driveways will extend from the road to the building locations on each lot. The NYS Department of Parks, Recreation and Historic Preservation has determined that the existing vacant dwelling on Lot 2 meets the criteria for inclusion on the State Register of Historic Places as a significant representative of vernacular design dating from the Town of Johnsburg’s settlement period. There are no wetlands or other water features on the project site.

Project Title: Town of Tupper Lake

Location: On or near New York State Route 28/30, Moody Road, Simon Pond Road and Ski Tow Road.

Project Description: The project consists of a new major public utility use involving the installation of approximately 45,000 linear feet of new sewer line which is designated Sewer District 23. There are wetlands within the project limits and portions of the project are located within the river area of the Raquette River, a designated “Recreational River” pursuant to the New York State Wild, Scenic and Recreational River Systems Act. Erosion control measures and directional drilling will be utilized in the vicinity of wetlands and water resources to protect wetlands and water quality of the area.

Project Description: The construction of a two-bay, 38 feet by 46.5 feet metal fabricated building, 23 feet in height at the Piseco Airport. The building will be utilized as a snow removal equipment building, office, unisex bathroom, and storage/display space. An existing wood-frame airport terminal building, adjacent hangar and an observation platform will be demolished as part of the project.

Project Title: Jeffrey and Susan Shambo

Location: East Side of Partridgeville Road, Brantingham, NY 13312, Lewis County

Project Description: The applicants seek approval for a new commercial use within an existing 1000 square foot structure, and will utilize the existing on-site water supply and on-site wastewater treatment system. The new commercial use involves a convenience store and coffee counter. The Brantingham Post Office is also located within the structure.


Negative Declaration for the Adirondack Park Agency 2005 State Land Classification And Public Hearing

Three public hearings will be held by the Adirondack Park Agency pursuant to Section 816 of the Adirondack Park Agency Act to classify or reclassify certain State lands within the Adirondack Park. The action will involve 70 State land classification proposals totaling approximately 47,575 acres and 8 State land reclassifications proposals totaling an estimated 26,308 acres. Total acreage involved in the action is approximately 73,880 acres. Three alternatives are presented for the proposed classification of the lands to the east and adjacent to the Carry Falls Reservoir Areas in St. Lawrence County. The classification proposals involve lands in nine counties including: Essex, Franklin, Hamilton, Herkimer, Lewis, St. Lawrence, Saratoga, Warren and Washington Counties.

The proposed action involves only the classification or reclassification of State lands according to the provisions of the Adirondack Park State Land Master plan. This action does not authorize the development of new structures or improvements without prior SEQRA assessment by the Department of Environmental Conservation and/or the Adirondack Park Agency. More detailed maps tables and narrative describing the proposed action, may be obtained at the Adirondack Park Agency. The same materials are available from the Adirondack Park Agency’s website at www.apa.state.ny.us.

Notice Of Acceptance Of Draft Generic EIS And Public Hearing

Saratoga County - The Town of Malta, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed Comprehensive Master Plan Update. A public hearing on the Draft Generic EIS will be held on June 8, 2005 at 7:00 p.m. in the Meeting Room, Malta Town Hall. Public comments will be accepted until June 22, 2005. The action involves the Town of Malta preparing a Draft Comprehensive Plan update and Generic Environmental Impact Statement (DGEIS) for the evaluation of future potential cumulative impacts of development within the Town. The Study Area encompasses the entire Town, which includes approximately 17,000± acres of land consisting of a mixture of residential, commercial, vacant/natural, recreational, and future industrial land.
