The applicant proposes the
mining of sand and gravel and material processing with a
portable dry-screen that has a maximum capacity less than 150 tons per hour, on14.0
acres of land. The estimated life of the mine is 15 years and the reclamation objective is
farmland with a potential for future construction of a residence. The haul road is an
exiting driveway shared with an existing residential development, North View Circle and
with Yansick Lumber Company. The proposed mine location is about 700 feet east of
NYS Route 19, at approximately 1500 feet south from the Rice Road intersection.

The applicant proposes to
discharge1,960 gallons per day of treated sanitary wastewater
from a septic tank/sand filter system to a tributary of Cazenovia Creek (Spring Brook)
from Sahlen's Sports Park. The facility, located at 7070 Seneca Street, is an indoor sports
field complex for practices and competition, and includes four bowling alleys, a pro shop
and snack stand. The Department has made a tentative determination to issue a State
Pollutant Discharge Elimination System (SPDES) Permit under Article 17 of the NYS
Environmental Conservation Law. This tentative determination indicates that the
discharge regulated under this statute is considered to satisfy regulatory standards for
permit issuance, based on information available to the Department at this time. The
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. As such the tentative determination does not signify
Department approval for or endorsement of the activity for which a permit is sought or

As part of the development
of the 86 lot Woodstream Estates Subdivision, it is proposed
to fill approximately 0.678 acre of State regulated and Federally jurisdictional wetland.
The fill is associated with the construction of a single, 90 foot wide access road which
will serve as the only ingress/egress to the proposed subdivision. As mitigation for
filling the 0.678 acre of wetland, a total of 1.01 acres of wetland mitigation consisting of
wet meadow, emergent marsh and open water habitat is proposed on-site. The
Woodstream Estates Subdivision is located on approximately 70 acres east of and
adjacent to Rogers Road, between Lake Heights Apartments and Lakeside Memorial
Park (Cemetery).

The applicant proposes the
construction of a 1.5 million gallon elevated water storage
tank which will stabilize pressures and provide additional fire flow service to the Town of
Newstead and surrounding communities. The project includes the
construction/installation of a 16 foot-wide bituminous driveway and two 16 inch
waterlines within NYS regulated Freshwater Wetland WO-42 and its 100 foot wide
regulated adjacent area. Construction of the road involves 0.04 acre and 0.1 acre of fill to
be placed in WO-42 and the 100 foot wide regulated adjacent area, respectively. As
mitigation, the applicant proposes construction of two vernal pools approximately 0.02
acre in size within the project site.

The company proposes to
continue development of it's existing brine well field over a
three year period. Four wells would be located within regulated freshwater wetland WY-15. Two
wells would be within the regulated 100 foot wide adjacent area of the wetland.
The site is west of Saltvale Road between its intersection with Cowie and La Grange
Roads and east of Oatka Creek. Gravel access roads, underground connection pipes and
well drilling construction pads would be constructed as part of the expansion. Roads and
construction pads would be removed upon closure of the wells. Mitigation for
disturbances to the wetland and adjacent area has been proposed to be a series of five
ponds, with islands, within the wetland to provide open water areas for waterfowl
breeding and brood rearing.
