The New York State Department of Environmental Conservation (NYSDEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) 27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor indicated above has submitted a BCP application for investigation of the site indicated above.

NYSDEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Steuben County - The Corning Painted Post Area School District, as lead agency, has determined that the proposed Corning Painted Post Area School District 2005 Bond Vote will not have a significant adverse environmental impact. The action involves the Corning Painted Post Area School District proposing to complete additions and renovations at its two Middle Schools, Corning Free Academy and Northside Blodgett. In addition, the District is proposing to convert an existing manufacturing facility into a new 500-student Middle School allowing enrollment at the two existing Middle Schools to be reduced by approximately 250 students each. The District is also proposing the purchase of five parcels adjacent to existing District facilities. The project is located at various locations within the City of Corning, Town of Corning and Town of Erwin, Steuben County.

Yates County - The Town of Benton, as lead agency, has determined that the proposed Benton Water District No. 2 will not have a significant adverse environmental impact. The action involves the determination and reaffirmation of the Negative Declaration and Determination of Non-Significance based upon the Map, Plan and Report, the Public Hearing record, the Full Environmental Assessment Form prepared for this action and the Determination of Non-Significance previously made on August 11, 1997 for this project. The project is located in the Town of Benton.

Notice Of Acceptance of Draft Generic EIS

Steuben County - The Steuben County Industrial Development Agency, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed Ecogen, LLC Prattsburgh/Italy Wind Farm. A public hearing on the Draft Generic EIS will be held on Monday, May 23, 2005, from 6:00 p.m. to 9:00 p.m. at the Prattsburgh Central School, 1 Academy Street, Town of Prattsburgh, NY. Written comments on the Draft Generic EIS will be accepted until Friday, June 17, 2005. The action involves the construction of 53 wind turbine generators (WTG), each capable of generating up to 1.5 MW (79.5 MW total) of electrical power. The project includes the construction of an electric collection system (ECS) that would interconnect the individual WTG and connect with the existing NYSEG power grid; construction of a substation and an operation and maintenance building; and construction of required ancillary service roads. Power generated from the Project will be conveyed directly to the New York State Electric & Gas (NYSEG) transmission lines.

The WTG will consist of a tubular, steel monopole tower approximately 80 m (262 ft) in height. Each tower will have three rotor blades. The approximate net diameter of the rotors and hub will be 77m (253 ft). The height of the WTG will be approximately 119m (389 ft) with a blade in the perfectly vertical position. Typical WTG sites will be 0.8 acres with a finished site having a gravel or concrete pad measuring approximately 40 ft. by 120 ft. Approximately 4.8 miles of 34.5 kV buried cable will be required to connect the WTG and tie into the substation where the ECS will be connected to the NYSEG power grid via a 115 kV transmission line.

The Project, including the ancillary facilities, represents a cumulative conversion of approximately 75 acres of land. The Project is located within an overall study area totaling approximately 33,000 acres in the Town of Prattsburgh in northeast Steuben County and the Town of Italy in south-central Yates County. The Project area is generally bounded by Twelve Mile Creek Road to the west, McMichael Road to the east, Shay and Sliter Roads to the North and West Creek Road to the south.

Notice Of Acceptance Of Draft EIS

Monroe County - The Town of Perinton, as lead agency, has accepted a Draft Environmental Impact Statement on the proposed Packard-Waymon Subdivision. Written comments on the Draft EIS will be accepted by the contact person listed below until May 31, 2005. The action involves Metrose Builders owner of property located at the north side of Route 31F, south side of Whitney Road, between Wakeman Road, Macedon Center Road and Countyline Road, Fairport, New York, requesting subdivision approval for a proposed 155 lot single-family residential subdivision of approximately 216.4 acres under Section 278 of Town Law. Tax Account #ís 154.01-01-12.1 and 154.03-01-16.2.
