The Department has prepared
a Draft Permit and has made a tentative determination to
approve this application for an Air State Facility Permit. ADM Milling Co is a flour mill
that receives grain by truck and stores it in bins prior to cleaning it and milling it into
flour and by-product feed. 6NYCRR Part 201-3.2(c)(8) exempts from permitting all grain
storage elevators with capacities less than one million bushels and associated operations.
General fumigation of the facility is performed on a regular basis; the fumigation
products contain methyl bromide, which is a Hazardous Air Pollutant (HAP). Therefore,
an Air State Facility permit is required. The Draft Permit contains an emission limit
which caps the facility under the major source threshold for an individual HAP emission,
which is 10 tons per year, as defined in 6NYCRR Part 201-2.1(b)(21). ADM is required
by this permit to maintain records documenting the actual emissions of methyl bromide
on a monthly basis and shall submit an annual emissions report to the Department to
demonstrate compliance. The Draft Permit, with conditions, application, relevant
supporting materials and regulations are available during normal business hours at the
DEC office provided in this notice. Comments of support or objection may be made by
filing a written statement by the deadline date indicated.

The Department has made
a tentative determination to approve this application for
modification of an existing SPDES Permit (NY-0003077) which adds outfall 004, a
discharge into the NYS Barge Canal, removes flow limits for the existing discharge of
quarry stormwater at outfall 001 from the permittee's settling pond into the canal, adds a
schedule of compliance for a short term monitoring program for cadmium at outfall 004
and adds limits and monitoring requirements for pH at outfall 003. The quarry is located
on Hinman Road east of Route 270 and west of the NYS Barge Canal. A draft permit
and fact sheet is available for inspection at the NYS DEC Region 9 Office.
