The applicant proposes a 10.5 acre expansion of an existing sand and gravel mine to mine approximately 170,000 cubic yard of additional material from the expansion area.  The existing mine is located on the west side of Benson Hill Road, approximately 0.6 mile north of the intersection with Maple Lane.  The additional material will be processed on site using equipment already in use; no additional processing equipment is proposed.  The existing approved mine includes 18 acres, 7 of which have already been reclaimed to agricultural use.  The propsed reclamation objective for the expansion area is also agricultural use.

The applicant proposes to construct a driveway and install a well within State regulated Freshwater Wetland DP-26 (Class II) and its Adjacent Area for a single family dwelling to be located outside the regulated area.  The 12 foot wide driveway will result in the filling of approximately 0.1 acres of the wetland and 0.3 acres of the Adjacent Area. The applicant proposes to plant native wetland species within the Adjacent Area and remove 4 areas of debris and refuse from the wetland as mitigation for the new disturbance.  The site is located on the east side of Foxwell Terrace, approximately 2,000 feet south of the intersection with Mills Road.

The applicant proposes to cross approximately 60 feet of the  adjacent area of Freshwater Wetland C-2 (Class:2) with a common driveway to serve three proposed residences in conjunction with the subdivision of 52 acres into three lots. The location is on the south side of Kerleys Corners Road approximately 1/2 mile west of the intersection with Route 9.

The applicant has applied for a permit to discharge 5,000 gallons per day (gpd) of treated, sanitary wastewater to an unnamed tributary of the Otter Kill, Index # H-89-20-trib, Class C.  The sanitary discharge will be from a proposed 68, 000 square foot indoor recreation facility with outdoor tennis courts and a pool, located between Route 17M and State Route 17 west of Arcadia Road.

The Department has made a tentative determination to issue a State Pollutant Discharge Elimination System (SPDES) permit under Article 17 of the Environmental Conservation Law for this discharge.  This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time.  The application and draft permit, containing NYS DEC proposed effluent limits and monitoring requirements, are available for public inspection at the NYS Department of Environmental Conservation, Region 3, New Paltz office.  As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance.  As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought.

    The Department of Environmental Conservation (DEC) has received an application to re-issue/re-new  the following pre-existing EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue/re-new this pre-existing permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 34,500 gallons per day of treated sanitary waste to a tributary of the Hudson River.

    Additional information on this permit may be requested from or inspected at the NYSDEC Central Office in Albany.  Substantive comments must be submitted in writing to the contact person.  To be called substantive, 6 NYCRR Part 621.7 requires public comments "explain the basis of opposition and explain specific grounds..." for opposition.

    The Department of Environmental Conservation (DEC) has received an application to re-issue/re-new  the following pre-existing EPA minor Private/Commercial/Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.  DEC has made a tentative determination to re-issue/re-new this pre-existing permit for a five year term maintaining current effluent limitations and monitoring and reporting requirements.  This permit involves the surface discharge of up to 36,000 gallons per day of treated sanitary waste to a tributary of the Hudson River.

The applicant proposes to construct a 42-inch wide "catwalk" crossing approximately 700 feet of Freshwater Wetland HL-50 (Class: 2) in order to access the open waters of Highland Lake. The location is on the west side of the Lake, east of Hartung Road, approximately mid-way between Highland Lake Road and Steges Road.

The applicant proposes to construct improvements to an existing municipal wastewater treatment plant (WWTP) located partially within the 100 foot adjacent area of Freshwater Wetland G-1 (Class II).  The proposed upgrades will allow the plant to replace failing equipment and will provide additional treatment capacity to meet projected future demand.  No disturbance within the wetland is proposed; the total area of disturbance to the adjacent area of the wetland is approximately 0.3 acre. The project includes construction of a new influent pump station, four new Rotating Biological Contactor (RBC) units, equalization pumps, rotating drum thickener, sludge storage tank and building, odor control system, expansion of the paved access drive and construction of new stormwater management facilities. The project is located on the west side of Business Park Drive, approximately 1000 feet south of NYS Route 22 in the Town of North Castle, Westchester County.
