The applicant has applied
for a permit to discharge 5,000 gallons per day (gpd) of treated,
sanitary wastewater to an unnamed tributary of the Otter Kill, Index # H-89-20-trib, Class
C. The sanitary discharge will be from a proposed 68, 000 square foot indoor recreation
facility with outdoor tennis courts and a pool, located between Route 17M and State
Route 17 west of Arcadia Road.
The Department has made
a tentative determination to issue a State Pollutant Discharge
Elimination System (SPDES) permit under Article 17 of the Environmental Conservation
Law for this discharge. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. The application and draft permit,
containing NYS DEC proposed effluent limits and monitoring requirements, are available
for public inspection at the NYS Department of Environmental Conservation, Region 3,
New Paltz office. As a tentative determination, the Department seeks comments on the
proposed regulated activity prior to making a final decision on permit issuance. As such,
this tentative determination does not signify department approval for or endorsement of
the activity for which a permit is sought.

The applicant proposes
to construct improvements to an existing municipal wastewater
treatment plant (WWTP) located partially within the 100 foot adjacent area of Freshwater
Wetland G-1 (Class II). The proposed upgrades will allow the plant to replace failing
equipment and will provide additional treatment capacity to meet projected future
demand. No disturbance within the wetland is proposed; the total area of disturbance to
the adjacent area of the wetland is approximately 0.3 acre. The project includes
construction of a new influent pump station, four new Rotating Biological Contactor
(RBC) units, equalization pumps, rotating drum thickener, sludge storage tank and
building, odor control system, expansion of the paved access drive and construction of
new stormwater management facilities. The project is located on the west side of
Business Park Drive, approximately 1000 feet south of NYS Route 22 in the Town of
