The
Department of Environmental Conservation (DEC) has received an application to
re-issue/re-new the following pre-existing EPA minor Private/Commercial/Institutional
State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a
tentative determination to re-issue/re-new this pre-existing permit for a five year term
maintaining current effluent limitations and monitoring and reporting requirements. This
permit involves the surface discharge through a septic tank and sand fliter of a maximum
of 2,250 gallons per day of treated sanitary waste to Little Sister Creek.

information on this permit may be requested from or inspected at the
NYSDEC Central Office in Albany.

The applicant proposes to
construct a multi-use development (mixed housing types and
commercial lots) project on an approximately 271 acre site bounded on the north by
Pleasant View Drive, the south by Walden Avenue, to the west by the Stony Brook
Subdivision and to the east by the Walden Trace Subdivision. The concept plan for the
site includes a north-south spine road and several stormwater retention/detention ponds.
The project site contains: NYS Freshwater Wetland LA-16 (Federal wetland 13/18), a
Class II wetland; two additional wetland areas regulated by the U.S. Department of the
Army, Corps of Engineers, Buffalo District Office; and Scajaquada Creek, a Class B
stream. The concept plan for full development of the project will impact approximately
0.81 acre of Wetland LA-16 for construction of the spine road, installation of utilities and
placement of fill for development of two commercial parcels. In addition, 5.02 acres
within the 100 foot-wide regulated adjacent area of Wetland LA-16 will be impacted for
stormwater retention areas, spine road construction, utility installation and the
development of the two commercial parcels. Other Department Permits/Approvals
include a Protection of Water Permit for the spine road culvert crossing of Scajaquada
Creek and Water Quality Certification pursuant to the Federal Clean Water Act for
impacts associated with federal wetlands. As mitigation for impacts to state and federal
wetlands and state regulated wetland adjacent area, the project sponsor proposes the
construction of two shallow wet-meadow/emergent marshes with a combined total of
approximately 5.0 acres; creation of an upland buffer area/wildlife corridor connecting
Scajaquada Creek and Wetland LA-16; and deeding over to the Town of Lancaster an
approximately 42 acre area (containing the undisturbed portion of Wetland LA-16, its'
regulated adjacent area and additional non-regulated upland areas) of the property for use
as a passive recreational park. Full development of the site is anticipated to occur within
25 to 35 years.

The applicant is proposing
the installation of a complete water supply and distribution
system to serve the newly created Town of Newstead Water District No. 10, which will
also interconnect and provide Erie County Water Authority (ECWA) water to Newstead
Water Districts (NWD) 1 and 3 and the Town of Alabama (Genesee County).
Approximately 150,000 gallons per day of water will be supplied from ECWA to
approximately 667 services in NWD 1, 3, 10 and the Town of Alabama, under the terms
of lease-management agreement. The project entails the installation of approximately
150,400 linear feet of 8 inch PVC waterline and associated appurtenances along road
right-of ways. Approximately 50 linear feet will be installed within NYS regulated
Freshwater Wetland WO-35 and the regulated 100 foot wide adjacent areas of NYS
Freshwater Wetlands CL-11 and WO-42 and will cross Ledge Creek, a regulated stream
(Class/Standard B), in three locations.
