Pursuant to Environmental Conservation Law, Sections 1-0101, 3-0301, 19-0103, 19-0105, 19-0301, 19-0303, 19-0305, and 19-0311, and Sections 3-101 and 3-103 of the Energy Law, the New York State Department of Environmental Conservation hereby gives notice of the following:
NOTICE OF ADOPTION OF RULE on March 28, 2005, to be effective April 27, 2005, amendments to 6 NYCRR Part 200, General Provisions, 6 NYCRR Part 237, Acid Deposition Reduction NOx Budget Trading Program, and 6 NYCRR Part 238, Acid Deposition Reduction SO2 Budget Trading Program.
The adoption of this rule is intended to reduce emissions of NOx and SO2 from fossil fuel-fired electric generating sources statewide through market based cap-and-trade programs.

The New York State Department of Environmental Conservation (DEC) is accepting applications for Technical Assistance Grants (TAGs). TAGs are a citizen participation tool available to eligible community groups to increase public awareness and understanding of remedial activities taking place in their community. Eligible community groups may apply to receive grants for up to $50,000 per eligible site. TAGs, in the form of State Assistance Contracts (SACs), are available to eligible community groups for the purpose of obtaining independent technical assistance in interpreting existing environmental information about an eligible "significant threat" site being remediated in the State Superfund Program or Brownfield Cleanup Program.
Technical assistance is intended to help the grant recipient and the community it represents understand existing environmental data developed about the site, comment on site remedial activities and proposals, and share this information with the public. Eligible community groups must be non-responsible parties incorporated as not-for-profit corporations under section 501(c)(3) of the Internal Revenue Code. An eligible community group must certify that its membership represents the interest of the community affected by the site, and that its members’ health, economic well-being or enjoyment of the environment are potentially threatened by the site.

Applications are now being accepted by DEC on a continuous basis. There is no matching contribution required on the part of the grant recipient.
Introduction: This notice is issued pursuant to part 617 of the implementing regulations of the State Environmental Quality Review Act (“SEQRA”; Article 8 of the New York Environmental Conservation Law). A Final Generic Environmental Impact Statement (“FGEIS”) has been completed, accepted and distributed for public review by the New York State Office for Technology as project sponsor and lead agency for the proposed action described below.
Name of Proposed Action: New York State Statewide Wireless Network (“SWN”)
SEQRA Classification: Type I action, as that term is defined in 6 NYCRR section 617.4
Lead Agency: New York State Office for Technology (“OFT”), Statewide Wireless Network Project Office, State Capitol, ESP, Albany, New York 12220-0062
Location of the Action: The proposed action is a Statewide project. A generic environmental impact statement has been completed by OFT because the exact locations of the SWN antenna facilities and operations centers (“SWN Facilities”) described below have not yet been determined. OFT expects that the SWN project will involve the establishment of SWN Facilities at locations across New York. The eventual locations will be selected to avoid, to the extent practicable, previously undeveloped sites.
Brief Description of the Action: OFT proposes to develop the SWN for voice and data radio communications services to enable public safety and public service entities operating within the State of New York to better respond to and protect its citizens. The SWN will provide essential connectivity to coordinate the delivery of governmental services to the citizens of New York, and to enable immediate coordination of public safety resources in emergency situations to ensure the public’s safety and welfare. The proposed SWN project is fundamentally an infrastructure, a collection of radio sites throughout the state interconnected by a network, monitored and controlled by a pair of redundant operations centers. The proposed action is the deployment of the SWN, which includes the primary regional build out, final engineering design, Statewide implementation involving the construction and operation of the Network and ongoing maintenance of the SWN.

Filing & Publication: Pursuant to 6 NYCRR part 617.12(b) a copy of this Notice of Completion and this FGEIS must be sent to: (a) the chief executive officers of the political subdivisions in which the action will be principally located; (b) the lead agency and project sponsor (OFT); (c) all involved agencies; and (d) any person who has requested a copy. A copy of the FGEIS must also be filed with the Department of Environmental Conservation (“DEC”) Division of Environmental Permits, and with the Secretary of State. Contemporaneous with the publication of this Notice of Completion, OFT circulated copies of the FGEIS to approximately 1,800 potentially involved or interested agencies, including the executive officers of counties, cities, towns and villages in New York; members of the public requesting a copy; the DEC, Division of Environmental Permits (625 Broadway, Albany, NY 12233-1750); and the Secretary of State. The FGEIS is available on the OFT website at www.oft.state.ny.us/swn. A hard copy of the FGEIS is also available at the public locations described below.
OFT is required to publish this Notice of Completion only in the Environmental Notice Bulletin (Department of Environmental Conservation, Room 538, 625 Broadway, Albany, NY 12233-1750). A Notice of Completion will also be published in the New York State Register and 16 newspapers of general circulation throughout the state.
