The applicant proposes a
discharge of 100,000 gallons per day of treated sanitary
wastewater to Canaseraga Creek, a Class C(t) waterbody from a wastewater treatment
plant at the applicant's facility in the Town of Burns, Allegany County. The applicant
plans to build a Sequencing Batch Reactor (SBR) and provide secondary and tertiary
treatment.
This Department has made
a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation Law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. The Department seeks comments
on the proposed regulated activity prior to making a final decision on permit issuance. As
such, this tentative determination does not signify Department approval for or
endorsement of the activity for which a permit is sought or for the overall proposed

The Department has prepared
a Draft Air State Facility Permit and has made a tentative
determination to approve this application for the Buffalo Crushed Stone Wehrle/Barton
quarry in the Towns of Clarence and Lancaster. The facility includes a crushing and
screening operation which produces construction aggregates and aggregate for the
manufacture of hot mix asphalt. The facility also has an asphalt batch plant and two
asphalt drum plants. The draft permit contains conditions which limit the facility's ability
to emit oxides of nitrogen (NOx ), particulates, PM-10, carbon monoxide (CO), and
volatile organic compounds (VOC) to less than the major facility threshold value of 100
tons per year (tpy) of each contaminant other than VOC, which has a major facility
threshold value of 50 tpy. If all facility emission sources were used concurrently and
continuously, the above emissions would exceed the major facility thresholds for the
contaminants. The capping conditions provide specific formulae for calculating
emissions of the contaminants for each emission source. Buffalo Crushed Stone is
required to annually certify continuous compliance with the emission caps through use of
a 12-month rolling total emission rate, calculated on a monthly basis. The application,
supporting documentation, draft permit and regulations are available for review during
normal business hours at the Region 9 Office of the NYSDEC in Buffalo.
