NYSDEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Monroe County - The Town of Brighton Town Board, as lead agency, has determined that the proposed Walgreens Pharmacy will not have a significant adverse environmental impact. The action involves the construction of a 14,820 square foot pharmacy with twenty-four hour operation, a drive thru and associated site improvements; demolition of the existing 29,363 square foot building; construction of on-site and off-site sidewalks along both Elmwood Avenue (from South Clinton Avenue to west of David Avenue, approximately 1,960 L.F.) and S. Clinton Avenue (from Elmwood Avenue boundary to Highland Avenue, approximately 2,360 L.F.). The project is located at 1650 Elmwood Avenue, Town of Brighton.

Monroe County - The Gates Chili Central School District, as lead agency, has determined that the proposed Phase IX - School Additions and Renovations will not have a significant adverse environmental impact. The action involves energy performance improvements, infrastructure repairs, renovation and new construction and site development modifications at the following schools: Gates Chili High School, Gates Chili Middle School, Neil Armstrong Elementary, Florence Brasser Elementary and Washington Irving Elementary, Transportation and Facilities Complex, Paul Road Elementary, Walt Disney Elementary and Administration Building. The project will prepare the district to serve the future educational, physical, social and emotional needs of the students.

Project Description: The action involves an early spring prescribed fire designed to rejuvenate desirable grass species on 19 acres, in accordance with recommendations in the Canisteo River Basin Unit Management Plan. The plant community being burned is a fire climax community that requires frequent fire to survive and thrive.
Wayne County - The Planning Board of the Town of Macedon, as lead agency, has determined that the proposed Wal-Mart Supercenter and gasoline sales facility will not have a significant adverse environmental impact. The action involves the construction of an approximately 205,000 square foot Wal-Mart Supercenter and a 5-pump gasoline sales station. The project site will result in the re-subdivision of existing tax parcels to create an approximately 21.84 acre lot for the Wal-Mart Supercenter, approximately a 1.46 acre lot for the gasoline sale facility, 3.31 acres for a proposed town righ-of-way and 3.64 acres to be retained by seller. The project also includes provisions for paved parking, highway access point onto NYS Route 31 and Wayneport Road, utility services, storm water management and wetland mitigation facilities. The project is located on the north side of NYS Route 31 approximately 500' east of the intersection of Route 31 and Wayneport Road in the Town of Macedon.

Orleans County - The Town of Albion Town Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Comprehensive Plan Amendment, text amendments to Zoning Ordinance to allow large scale stores in General Business Districts, and automobile service stations and/or filling stations on the same parcel as a special use, Wal-Mart Supercenter. The action involves the Town of Albion considering an amendment to its Comprehensive Plan that recommends the extension of the General Business (B) District west of the intersection of Route 31 and Gaines Basin Road. Such an amendment is consistent with the goals of the Comprehensive Plan to expand the tax base and create employment opportunities in the Town, while still preserving the majority of land use in the Town to agricultural and residential. The properties are currently zoned R-1 Residential and would be rezoned to General Business (B) District. The Town of Albion is also considering a text amendment to its Zoning Code that would allow the allow large retail development as a permitted use in a General Business (B) District, and would allow the use of automobile service stations and/or filling stations on the same parcel of property as retail use over 50,000 square feet upon the issuance of a special use permit by the Planning Board. The Town Planning Board, after a public hearing, recommended approval of the Comprehensive Plan Amendment and zoning text change.
A Wal-Mart Supercenter is proposed to be located on a vacant parcel of land, in the Town of Albion, Orleans County, at the southwest intersection of New York State Route 31 and Gaines Basin Road. The Wal-Mart property represents a small portion of the land proposed to be rezoned to General Business (B) District. The proposed Wal-Mart Supercenter will consist of a single story building containing approximately 155,000 square feet of floor area with paved parking, access driveways, utilities and storm water facilities to support the proposed site, and a gasoline service station. The building will contain interior sections for retail sales, grocery, pharmacy, tire lube express, garden center, photo center, snack bar and vision center. The project site is located at the southwest intersection of New York State Route 31 and Gaines Basin Road in the Town of Albion, Orleans County.
A Draft Generic Environmental Impact Statement/Draft Environmental Impact Statement (“DGEIS/DEIS”) was accepted by the Town of Albion Town Board and declared adequate for public inspection on January 3, 2005. A public hearing on the DGEIS/DEIS was held on February 14, 2005, and public comments were accepted up until ten (10) after the public hearing.
