The applicant proposes to mine sand and gravel with material processing by a small (less than 150 tons per hour capacity) portable dry-screen, affecting 10 acres of land by leveling off a knoll. The estimated life of the mine is 20 years and the reclamation objective is agriculture. The site is north and west of Haskell Road (Cattaraugus County Route 79) and Haskell Creek, approximately 1450 feet east of Windfall Road with its haul road accessing Windfall Road.
State Environmental Quality Review (SEQR) Determination:
Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.
SEQR Lead Agency:
NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination:
A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than Apr 15 2005.

The Department has prepared a draft permit and made a tentative determination to issue a State Pollution Discharge Elimination System permit (NY-0269514) for the discharge of non-contact cooling water to Scajaquada Creek which has a Water Index Number of O-158-15 and a classification of B. The application states that the maximum discharge rate would be 1,900 gallons per day. The draft permit sets the maximum temperature of the discharge at 90 degrees Fahrenheit in accordance with Department standards. Temperature would be monitored monthly. Flow rates would be estimated on a monthly basis. The draft permit, fact sheets, application, and applicable regulations are available for inspection at the NYSDEC Region 9 Office. Comments in support of or in opposition to the proposed permit may be made by filing a written statement by the deadline date indicated.
