The Department has received
an application for the above referenced wastewater permit.
PCORE Electric Company has purchased the assets of Lapp Bushing Operations from
Lapp Insulator Company, LLC which includes Outfalls 003, 004, and 005 that discharge
to Oatka Creek, a Class C stream. PCORE will be performing the same manufacturing
operations as Lapp, therefore they will be discharging the same pollutants as those
previously discharged by Lapp. Outfalls 003 and 005 are stormwater only and Outfall
004 is process water, non-contact cooling water, test pit water and stormwater and has
effluent limits for oil & grease, temperature, iron and tetrachloroethylene. There are also
action levels for chloroform, dichlorobromomethane, 1,1 dichloroethane, methylene
chloride, toluene, and 1,1,1 trichloroethane. In addition to the three outfalls, Best
Management Practices pages have been included in the draft permit. The wastewater
permit for Lapp Insulator Company, LLC will be modified in conjunction with this
proposed new permit to delete the outfalls that will be covered by the PCORE wastewater
permit.
The Department has made
a tentative determination to issue a permit for a State Pollutant
Discharge Elimination System permit under Article 17 of the Environmental
Conservation law. This tentative determination indicates that the discharge regulated
under this statute is considered to satisfy regulatory standards for permit issuance, based
on information available to the Department at this time. As a tentative determination, the
Department seeks comments on the proposed regulated activity prior to making a final
decision on permit issuance. A draft permit is available for review.

Applicant is proposing a
36 lot residential subdivision on a 17.2 acre parcel in the
Village of Lima. The project site is located immediately west of Kober Drive. Site
development will include re-location of an unnamed unclassified tributary of Spring
Brook and construction of a wetland mitigation pond which is part of the project
stormwater management plan. The project will involve filling of 0.38 acres of federal
wetland. As mitigation a 0.76 acre wetland mitigation will be constructed. The Village
will maintain a conservation easement on the 2.43 acres of existing and constructed
wetlands stream corridor, fringe wetlands, and adjacent uplands. The project sponsor will
be required to comply with the NYSDEC SPDES General Permit for Stormwater
Discharge from Construction Activity, Permit No. GP-02-01.
