The
Department of Environmental Conservation (DEC) has received an application to
re-issue/re-new the following pre-existing EPA minor Private/Commercial/Institutional
State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a
tentative determination to re-issue/re-new this pre-existing permit for a five year term
maintaining current effluent limitations and monitoring and reporting requirements. This
permit involves the surface discharge through a sub-surface sand filter of up to 850
gallons per day of treated sanitary waste to a Webatuck Creek.
Additional
information on this permit may be requested from or inspected at the
NYSDEC Central Office in Albany. Substantive comments must be submitted in writing
to the contact person. To be called substantive, 6 NYCRR Part 621.7 requires public
comments "explain the basis of opposition and explain specific grounds..." for
opposition.

The applicant proposes to
redevelop the existing New Paltz Plaza, located on the north
side of the intersection of Rt 299 and Cherry Hill Road, by demolishing and removing the
structure along the north boundary of the property (formerly housed Ames and 2 other
retail stores), removing some of the existing pavement, placing approximately 20,000
cubic yards of off-site fill material to raise portions of the property up to 5 feet, and
constructing a new building within a similar footprint to the existing structure with some
new paving for a revised parking lot configuration. Stormwater collection and treatment
systems are incorporated into the plaza redevelopment design. A freshwater wetland
permit is required for disturbance to the adjacent area of DEC regulated Freshwater
Wetland CD-39 (Class III).

The applicant proposes to
construct a portion of a 20,600 square foot child care facility
within the 100-foot adjacent area of State-designated Freshwater Wetland K-12 (Class II).
The four acre project site is located at the end of Morgan Drive approximately 700 feet
from the intersection with Radio Circle. As proposed, approximately 18,120 square feet
of the wetland adjacent area will be disturbed by construction of stormwater detention
basins (18,000 square feet), play yards (50 square feet), and parking (70 square feet). The
remainder of the facility will be constructed outside of the regulated area. Portions of the
stormwater detention basins will be enhanced with wetland plantings.
