The applicant proposes
to construct a 38 lot subdivision on approximately 225 acres,
known as Tally Ho Equestrian Community. Thirty two (32) of the lots will be served by
two community central sewage disposal systems with a total subsurface flow of 16,640
gallons per day (gpd). The remainder of the lots will have individual septic systems. The
site is located on the north and south side of Schefflers Road.
The Department has made
a tentative determination to issue a State Pollutant Discharge
Elimination System (SPDES) permit under Article 17 of the Environmental Conservation
Law. This tentative determination indicates that the discharge regulated under this statute
is considered to satisfy regulatory standards for permit issuance, based on information
available to the Department at this time. The application and draft permit, containing
NYS DEC proposed effluent limits, are available for public inspection at the NYS
Department of Environmental Conservation, Region 3, New Paltz office. As a tentative
determination, the Department seeks comments on the proposed regulated activity prior
to making a final decision on permit issuance. As such, this tentative determination does
not signify department approval for or endorsement of the activity for which a permit is
sought.

The applicant proposes
to mine sand and gravel from a 12-acre total life-of-mine on a 50-acre parcel over the five year
permit term. Mining is proposed to be performed in three
phases (approximately 3.5 acres per phase) and approximately 250,000 cubic yards of
bank run gravel is proposed to be removed. No processing of material will occur on site.
Reclamation of mined areas will be concurrent with on-going mining operations.
Proposed final reclamation will return the mine site to agricultural use as pasture land on
the operating dairy farm. The proposed mine is located on the west side of Winterton
Road (County Route 62) at the intersection with Winters Lane.
