The applicant proposes construction
of a 24.7 foot high earth dam that will create a 1.46
acre private pond, designed to impound 10.488 acre feet of water at the permanent pool
elevation. The service and auxiliary spillways will discharge to existing streams. The
dam will be constructed to handle flows from a 100 year storm event. The pond location
will be approximately 3,000 northeast of the Osmun and Baird Road intersection.

The applicant proposes to
add a total of 88.50 acres to the Giardini Brothers' Gravel Pit
(formerly Rehler Gravel Pit) currently permitted for 20.5 acres in the Town of Allegany.
The expansion consists of 52.52 acres west of Gargoyle Road in the Town of Allegany
(West Site), and on the east side of Gargoyle Road, east of the City of Olean's fire
company training area (East Site), 26.68 acres in the Town of Allegany and 13.30 acres in
the City of Olean. Excavation below the groundwater table is proposed, deepening the
existing previously excavated 46.77 acre West Site lake to a maximum depth of 50 feet
and expanding the existing previously excavated 10.4 acre East Site lake to 24.35 acres,
also up to 50 feet deep. The existing material processing and stockpile area at the West
Site will remain at the same location with the addition of settling basins to eliminate
process water discharge into the lake. No processing is proposed at the East Site. A single
haul road is proposed to connect the East Site to the West Site, via a right-of-way across
the fire training area, continuing perpendicularly across Gargoyle Road. The estimated
life of the expanded mine is 74 years and the reclamation objective is private recreation.

The Department has made
a tentative decision to approve emission reduction credits
(ERCs) for reductions in emissions of Nitrogen Oxide (NOx) for the LFG Energy
Upgrade Facility located at 9951 Wehrle Drive in the Town of Clarence. As a result of
the closure of the LFG Energy Upgrade Facility and the permittee's surrender of the
facility's state air permit, the Department intends to certify 25 tons of Nitrogen Oxide
(N0x) emission reduction credits (ERCs). The request for ERCs and supporting
documentation are available for review at the NYSDEC Region 9 Office at 270 Michigan
Avenue, Buffalo, NY 14203-2999.

TPI Arcade Inc is an aluminum
foundry that melts virgin ingots for use in precision
molding operations and is located at 7888 Route 98 in the Town of Arcade. Modifications
to the Air State Facility Permit are proposed. Emissions of silica quartz sand from the
baghouse will be limited to 0.05 pounds per hour. A capping condition will limit casting
emissions to 45 tons of Volatile Organic Compounds (VOC) per year. Permit conditions
for particulate emission sources which include the 0.05 grains per day standard cubic foot
(gdscf) of exhaust gas emission standard will have compliance stack testing required at
the discretion of the Department. The maximum number of aluminum molds being
produced on the molding line will be limited to 25 per hour.
