The
Department of Environmental Conservation (DEC) has received an application to
re-issue/re-new the following pre-existing EPA minor Private/Commercial/Institutional
State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a
tentative determination to re-issue/re-new this pre-existing permit for a five year term
maintaining current effluent limitations and monitoring and reporting requirements. This
permit involves the surface discharge through a sand filter of up to 5,000 gallons per day
of treated sanitary waste to thje Modher Brook.
Additional
information on this permit may be requested from or inspected at the
NYSDEC Central Office in Albany. Substantive comments must be submitted in writing
to the contact person. To be called substantive, 6 NYCRR Part 621.7 requires public
comments "explain the basis of opposition and explain specific grounds..." for
opposition.

The applicant proposes to
construct thirteen 4-unit condominium buildings on a 13.35
acre parcel of land along the north side of Putnam Road across from Rotterdam Square
Mall and next to freshwater wetland S-115. Construction of the facility will require the
filling of 0.05 acre of federally regulated wetlands, filling and grading of approximately
0.06 acre of the adjacent area of wetland S-115 for site construction and filling and
grading of approximately 0.1 acre of the wetland adjacent area for the construction of two
stone-lined stormwater outlet aprons. The wetland portion the property, which comprises
approximately 6.54 acres of land, will be donated to the town and permanently protected
by a conservation easement. The facility will be served by the town's sewer and water
districts.
