re-issue/re-new the following pre-existing EPA minor Private/Commercial/Institutional
State Pollutant Discharge Elimination System (P/C/I SPDES) permit. DEC has made a
tentative determination to re-issue/re-new this pre-existing permit for a five year term
maintaining current effluent limitations and monitoring and reporting requirements. This
permit involves the surface discharge through a septic tank and sand filter of up to 3,300
gallons per day of treated sanitary waste to a tributary of the Hudson River.

NYSDEC Central Office in Albany. Substantive comments must be submitted in writing

Bradley Cook, LLC, has applied for Freshwater Wetland and SPDES
permits to construct the New England Equine Practice facility, which includes a
proposed 27,120 square foot horse veterinarian building, on a 31-acre parcel of
land at 2933 Rt 22, in the Town of Patterson, across from the Big Birch Ski Area.
As part of this construction, the applicant would create a 1.1 acre stormwater
detention pond within the 100-foot wide adjacent area of state regulated
Freshwater Wetland #DP-22, a Class 1 wetland, and various other features such
as driveways and parking areas. Mitigation for construction in the wetland
adjacent area includes restoration of about 0.14 acres of previously filled wetland
on this property. Disturbance of the wetland itself would be prohibited.
The applicant also applied for a SPDES General
Permit for a Subsurface
Discharge of up to 1,400 gallons per day of treated sanitary wastes through an
on-site septic tank and leachfield. The Department has reviewed and accepted
a Stormwater SPDES Pollution Prevention Plan (PPP) to control stormwater on
this site during and after construction.

The applicant proposes
to construct an Equestrian Center with, a 50 horse capacity, main
barn, indoor arena, outdoor riding ring, pastures, paddocks, run-in sheds and an apartment
on 28 acres. The proposed access road for this facility will be approximately 3,000 feet
long by 25 feet wide of this, approximately 1,300 linear feet are proposed within the 100
foot Adjacent Area of Freshwater Wetland BR-28, Class III. An existing turn-around
area will be removed and a 40 by 100 foot area for a new turn-around is proposed within
the Adjacent Area. The applicant has also applied for coverage under the State Pollutant
Discharge Elimination System (SPDES) General Permit (GP-95-01) for a subsurface
discharge of 1,350 gallons per day. The project is located on the south side of Ridgebury
Road approximately 500 feet east of Dingle Ridge Road.
